Acquisition of CNC lathe type with 7 axes and related services: installation, commissioning, training of a number of six persons (three operators, two programmers and a maintenance mechanic).

The bidders, third-party supporters and subcontractors must not be found in the situations provided for in art. 164, 165, 167 of Law no. 98/2016 regarding public procurement.

The way in which the requirement can be demonstrated: the DUAE will be completed by the economic operators participating in the award procedure with informationThe conditions related to their situation

The supporting documents proving the fulfillment of those assumed by completing the DUAE will be presented, at the request of the purchaser, only by the bidder ranked in the first place in the intermediate ranking drawn up at the end of the evaluation of the bids.

These documents can be:

1 . criminal record of the economic operator and the members of the administrative bodye, of management or supervision of the respective economic operator or of those who have power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / the constitutive document or, in the case of foreign bidders, equivalent documents issued in the country of residence;

2. certificate of fiscal attestation regarding the lack of outstanding debts regardingthe payment of taxes, taxes or contributions to the consolidated budget (local budget, state budget, etc.) at the time of their presentation or, in the case of foreign bidders, equivalent documents issued in the country of residence;

3. if applicable, documents by which the economic operator demonstrates that he can benefit from the derogations provided in art. 166 para. (2), art. 167 para. (2), art. 171 of Legea 98/2016, regarding public procurement;

4. other edifying documents, as the case may be.

The economic operator (associate leader, third party supporter) must comply with the rules for avoiding the conflict of interests provided by art. 59, 60 of Law 98/2016, regarding public procurement.

The way to fulfill the requirement: a declaration is required according to art. 59, 60 of Law 98/2016, regarding procurement publice that will be presented by all participants in the procedure, once the DUAE has been submitted.

Fitting in the situation provided in art. 59, 60 of Law 98/2016 on public procurement, attracts the exclusion of the tenderer from the procedure applied for awarding the public procurement contract.and the completion of the award procedure, respectively the persons who approve / sign documents issued in connection with or for the award procedure are: Huza Stefan Octavian, Bonciu Camelia, Carceanu Irina, Duta Costel, Ene Mara, Vasile Florin, Stanciu Denisa, Nistor Simona. The economic operators submitting the offer must prove a form of registration in the conditions of the law in the country of residence, from which it can be seen that they are legally constituted, that they are not in any of the situations of cancellation of the constitution, as well as the fact that they have the professional capacity to carry out the activities that are the subject of the contract. the economic operators participating in the award procedure with the information related to their situation. documentssupporting documents proving the fulfillment of those assumed by completing the DUAE, respectively a certificate issued by ONRC or, in the case of foreign bidders, equivalent documents issued in the country of residence, will be presented, at the request of the purchaser, only by the bidder ranked in the first place in the ranking intermediary drawn up at the end of the evaluation of the offers. The information from heaventhe verification certificate must be real / valid at the time of its presentation. For foreign legal entities / natural persons, the documents proving a form of registration / certification will be accompanied by an authorized translation into Romanian language. combination / sub paththe leader of the association, as well as the participation conditions for each tenderer, depending on the quality in which they participate in the association, must be submitted by the winning bidder.

If, in this situation, the offered scores are equal, then the buyer will split the bidders taking into account the highest score, related to the other evaluation factor, respectively the offer price 40 points. If and the scorethe other evaluation factor is equal, in order to designate the winning bid, the purchaser will request the submission of new financial proposals, in which case, the contract will be awarded to the bidder whose new financial proposal has the lowest price. The division will be done exclusively according to the price and not by quantifying other elements of a technical nature or other advantages thatresults from the fulfillment of the contract by the economic operators. In order to split the offers, the new financial proposals will be electronically submitted / uploaded by the bidders, following clarifications requested by the purchaser, through the SICAP. The bidders will upload in SICAP the documents containing the new financial proposals (Bid form, Price centralizer). Fwithout prejudice to the provisions of Law no. 182/2002 regarding the protection of classified information with subsequent amendments and completions, the economic operator will specify in the submitted offer those information included in the technical proposal and in the financial proposal considered to be confidential, classified protected by an intellectual property right, insofar as, in objectively, it revealstaking this information would harm the legitimate interests of the economic operator, especially with regard to trade secret and intellectual property.
