1. The contractor is excluded from the contract award procedure in respect of which any of the circumstances referred to in Article 24 sec. 1 item 12-23 of the PPL, with the exception of art. 24 sec. 1-point 13 lit. d PPL, and in the case referred to in art. 24 sec. 1 point 14 of the PPL, if the person referred to in this provision has been convicted of an offense listed in art. 24 sec. 1 point 13 lit. d PPL, pursuant to the provisions of art. 133 ust. 4 Pzp

2. In addition, the Employer will exclude the Contractor:

2.1. In relation to which the liquidation was opened, in the system approved by the court in the restructuring proceedingsthe liquidation of its assets or the court ordered the liquidation of its assets under Art. 332 par. 1 of the Act of 15 May 2015. Restructuring law (Journal of Laws of 2015, item 978, 1259, 1513, 1830 and 1844 and of 2016 item 615) or whose bankruptcy was announced, except for the contractor, who after the declaration of bankruptcy, he concluded a system approved by lawcourt order, if the arrangement does not provide for the satisfaction of creditors by liquidation of the assets of the bankrupt, unless the court ordered the liquidation of its assets in accordance with art. 366 para. 1 of the Act of 28 February 2003 Bankruptcy Law (Journal of Laws of 2015, item 233, 978, 1166, 1259 and 1844 and of 2016 item 615),

2.2. who in a way committed seriously violated professional duties, which undermines him-honesty, in particular when the contractor failed to perform or improperly performed the order as a result of intentional action or gross negligence, which the contracting authority is able to demonstrate by means of appropriate evidence;

2.3.words, for reasons attributable to him, did not perform or improperly performed in a substantially prior agreement on a public contract or a concession contractand, concluded with the ordering party mentioned in art. 3 par. 1 point 1 4 of the PPL, which led to the termination of the contract or award damages;

2.4. The breach of obligations relating to payment of taxes, fees or social security or health insurance contributions, which the contracting authority is able to demonstrate by means of appropriate evidence, except in the case referred to in art. 24 sec. 1 point 15 Pzp, unless the contractor has paid the taxes, charges or social security contributions, including interest or fines, or has entered into a binding agreement to repay those duties. Contractor who is subject to exclusion pursuant to art. 24 sec. 1 point 13 and 14 and 16 20 PPA or point 5.2. of this IDW, may provide evidence that the measures taken by him are-sufficient to prove its reliability, in particular to prove compensation for damage caused by an offense or fiscal offense, financial compensation for damage suffered or remedied, an exhaustive explanation of the facts and cooperation with law enforcement agencies and take specific technical, organizational and personnel resources that are appropriate for thedealing with further offenses or fiscal offenses or improper conduct of the contractor. The regulation referred to in the first sentence shall not apply if the contractor, being a collective entity, has been the subject of a final court ruling against applying for the order and the period of validity of the prohibition does not expire.

Other terms and conditionsgrounds for exclusion and deviations of the Employer in accordance with the ToR.

The Employer does not specify the condition for participation in proceedings regarding the economic or financial situation.

At the same time, the Employer reserves the need to present a commitment (conforms to Form 2.5.) to conclude an insurance contract and submit an OC before concluding a contract .

1. Offers, statements, including OświęcimInitial notice, shall be prepared under pain of nullity in electronic form and shall be provided with a qualified electronic signature.

2. The ordering party, for each part of the order, acting in accordance with art. 24aa Pzp, in the first place will evaluate the offers, and then will examine whether the contractor whose offer has been rated the highest is not subject to exclusion and meets the conditions for participation in the proceedingsIU.

3. Equipment and application requirements for work on the Purchase Portal: PC or MAC computer with permanent access to the Internet with a guaranteed bandwidth of not less than 1 Mb / s, any web browser installed, in the latest version.

4. The contractor is obliged to register on Purchase Portal, which enables him to obtain the status of a user with unique logsn and access password to the Shopping Portal. The registration process is one-time and allows access to all open tender procedures conducted by the Employer.

5. The contractor may ask the Ordering Party to clarify the content of the SIWZ, directing the request via the "Questions / Information" tab on the Purchase Portal. an editable form, -since the shortcut is the explanation time.

6. Using the Procurement Portal for Contractors is free.

7. Documents prepared in a foreign language are submitted together with a translation into Polish.

8. The Contracting Party provides for a Local Vision in accordance with point. 9a.4 SIWZ
