Timisoara City will at any time exclude the procedure for the award of the service contract, any economic operator who is in one of the situations stipulated in art. 60, 164, 165 and 167 of Public Procurement Law 98/2016.

Exclusion reasons will also apply to Associates / subcontractors / third parties-If the bid is rejected as unacceptable, each economic operator participating in the awarding procedure (tenderer, affiliate tenderer, subcontractor, third party, as the case may be) will present with the offer, complete DUAE with the information related to their situation.

You will be presented both on your own responsibility for non-compliancein the provisions of art. 60 of Law no. 98/2016 as well as, if necessary, the firm's firm commitment of the supporting documents accompanied by documents showing the actual manner in which the support, the subcontracting agreement and / or the association agreement will materialize.

The supporting documents proving the fulfillment of the assumed ones by completing the DUAE is to be presented, only at the request(1) ascertaining certificates for the absence of debts related to the payment of taxes, duties or contributions to the general consolidated budget (local budget, state budget, etc.) at the moment of the presentation;

2) the criminal record of the operationthe economic operator and the members of the administrative, management or supervisory body of that economic operator or of those having the power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / 3) where appropriate, documents demonstrating that the economic operator may benefit from the derogations-provided in art. 166 par. (2), art. 167 par. (2), art. 171 of Public Procurement Law 98/2016

1) In cadthe documents attached to the participation announcement, published in the SICAP (the new SEAP), DUAE is made available to economic operators interested in editable format in order to complete it by the bidders. The participating economic operators will fill in this document with the information / responses related to the inclusion / non-inclusion in the grounds for exclusion, respectively the fulfillment of the criteria(where explicitly stated) and will not be entitled to intervene on the DUAE format, respectively on the requirements imposed by the contracting authority; 2) For the visualization of the attached documents, op. ec. must have a program to view the electrically signed files(3) Economic operators have the right to submit the offer (complete DUAE, the declaration on non-compliance with the provisions of Article 60 of Law 98/2016, the technical proposal, the financial proposal, the proof of the guarantee guarantee and, if case, the supporting undertaking of the third party, the association agreements and / or subcontracting), only in the format-electronically, signed with extended electronic signature and only until the date and time limit set for submission of tenders in the tender notice; 4) Requests for clarification regarding this tender documentation will exclusively address the SICAP (the new SEAP) in within the award procedure conducted by electronic means, the contracting authority will not give withq Any interested economic operator has the right to request clarifications or additional information regarding the awarding documentation, in compliance with the deadline stipulated by the contracting authority in Section I - point 1.3) of the present document, not later than 15 days before the deadline-the limit set for receipt of tenders. According to art. 160 161 of Law no. 98/2016, the contracting authority will respond clearly and completely to all clarification requests / additional information 10 days before the deadline set for receipt of tenders, to the extent that they will be addressed within the specified term of Section I - point 1.3) of this document. The answers to the required clarifications will be published in the SICAP (the new SEAP) within the tender notice; 5) If the contracting authority requests the submission of certain clarifications / completions for the purpose of checking the compliance of the offer with the required requirements, both the bidding and the bidder's response are transmitted in SICAP only in electronic format, signed with the extended electronic signature. If the bidder's response is posted to the SICAP without the extended electronic signature, its offer will be assimilated to the provisions of Art. 137 par. (2) lit. j) from H.G. 395/2016, being rejected as unacceptable; 6) If, following application of the award criterion "prethe lowest rate "is that two or more first-ranked offers, equal prices, will be required to be re-routed through SEAP. If this is not feasible for reasons attributable to the SICAP operator, a new offline financial proposal will be requested from the bidders The contract will be awarded to the tenderer whose new financial proposal has the lowest price
