The contracting authority will respond clearly and completely to all clarification requests on the 10th day before of the deadline for submission of tenders, set out in the tender notice, as requestedClarifications are sent 15 days before the deadline for submitting bids. Clarifications submitted after this term will no longer be taken into account.

Timisoara City will exclude at any time the award procedure, any economic operator who is in one of the situations provided by art. 60, 164, 165 and 167 of Law 98/2016 on public procurement. Exclusion reasons will also be applied to associations / subcontractors / third-party supporters, as appropriate. Way of fulfillment: Under the sanction of rejection of the offer as unacceptable, each economic operator participating in the awarding procedure, (tenderer, associated tenderer, subcontractor, third party, as the case may be) will present with the offer, DUAE completed in accordance withArt. 193 par. (1) of Law 98/2016, with information relating to their situation. In addition to the DUAE, the following will be presented:

(a) Statement of non-compliance in situations potentially generating conflicts of interest, as defined in Art. 60 of Law no. 98/2016 - by all participants in the procedure and (b) where appropriate, the firm commitment of the third party to be supported by theevidences of the way in which its sustainability, subcontracting agreement and / or association agreement will materialize. The supporting documents proving the fulfillment of the undertaken by completing the DUAE shall be submitted, only at the request of the contracting authority, to the first ranked bidder after applying the award criterion to the admissible tenders. DocumentThe supporting documents may be:

1) certificates of lack of debts related to the payment of taxes, duties or contributions to the general consolidated budget (local budget, state budget, etc), 2) the criminal record of the economic operator and the members of the body administration, management or oversight of that economic operator or those having a repre sentative power(3) as the case may be, documents demonstrating that the economic operator may benefit from the derogations provided for in art. 166 par. (2), art. 167 par. (2), art. 171 of Law 98/2016 on Public Procurement; 4) other editorial documents, as the case may be. 1) Within the documents attached to the participation announcement, in the section "Documentation, clarifications and decisions", DUAE is available to economic operators interested in editable format in order to be filled in by the bidders. Participating economic operators will fill in this document with the reasons for the exclusion, respectively the fulfillment of the qualification criteria requested by the authority contractors who have a correspondent-(where explicitly stated) and will not have the right to intervene on the DUAE format, respectively on the requirements imposed by the contracting authority; 2) For the visualization of the attached documents, the economic operators must have a necessary program for visualization electronically signed files; 3) Economic operators have the right to submit the offer (DUEA completed, the declaration regarding non-compliance with the provisions of art. 60 of Law no. 98/2016, the technical proposal, the financial proposal, the proof of the guarantee guarantee and, if applicable, the support of the third party, the association agreements and / or the subcontracting agreements), only in electronic form, signed with the extended electronic signature only pa(4) Requests for clarification regarding this tender documentation will be addressed exclusively in the SEAP in the "Questions" section of the award procedure conducted by electronic means, the contracting authority will not respond to the requests addressed by another way cthan the established one. (2) lit. j) from H.G. 395/2016, being rejected as unacceptable; 6) If, following the application of the "Lowest Price" award criterion, two or more offers ranked first, In equal prices, the contracting authority will request re-routing through the SICAP. If for reasons attributable to the SEAP operator it is not feasible, a new financial proposal will be required offline.
