Chemical Reagents

Acquisition of chemical reagents according to the specification. We specify that: the deadline to respond to any clarification the date on which the contracting authority will respond in a clear and complete manner to all clarification requests / additional information: on the 10th day before the closing date for submitting bidsrt. 160 of Law 98/2016. Deadline for requesting clarifications: not later than 20 days before the deadline for submitting bids, in accordance with 161 of Law 98/2016, with subsequent modifications and completions

Tenderers, third parties and subcontractors must not find themselves in the situations referred to in art. 164, 165, 167 of the Law no. 98 / 2016.

At the same time, conf. 60 / Law 98/2016, which will be submitted by all participants in the award procedure (bidders, third parties, subcontractors) with the submission of the DUAE by the deadline for the submission of tenders.

The manner by which the fulfillment of the requirement can be demonstrated: will complete the DUAE by the economic operators• The supporting documents proving the fulfillment of the assumed by completing the DUAE are to be submitted, at the request of the contracting authority, only by the tenderers ranked on the first three places in the intermediate rankings drawn up at the completion of the evaluation of the tenders. These documents can be:

1) Certificates con(regarding the local budget, state budget, etc.) at the moment of the presentation  As regards the tax certificates, we state that they have to prove the lack of overdue debts at the moment of their presentation observation valid also for the operators of foreign legal / physical persons, who wish to participate in the procedure; 2) the criminal record of the economic operator and the members of the administrative, management or supervisory body of the respective economic operator or those having the power to represent, decide or control him / her; as evidenced by the certifying certificate issued by the ONRC / constitutive act, 3) as the case may be, documents demonstratingthat the economic operator may benefit from the derogations provided for in art. 166 par. (2), art. 167 par. (2), art. 171 of the Public Procurement Law 98/2016

4) Other editing documents, as appropriate

We mention that in the case of operators - foreign legal / physical persons, whatthey want to participate in the procedure, they will present any editorial documents issued by the competent authorities of the country where they are residents, proving the fulfillment of the due taxes due to the state budget and the local budget in accordance with the legislation of the country of residence. The documents shall be accompanied by the authorized translation of aNote: The certificates required in this section may be presented in any of the following forms: original / legalized copy / legible copy with the mention "according to the original".

Economic operators submitting the tender must prove a registration form in accordance with the law of the country of residence, that the economic operator is legally constituted, that it is notin any of the situations of cancellation of the establishment and the fact that it has the professional capacity to carry out the activities covered by the framework agreement.

Way by which the fulfillment of the requirement can be demonstrated: it will be completed by the economic operators participating in the award procedure with the information relating to their situation.

The supporting documents that proveto fulfill the assumed ones by completing the DUAE, respectively:

1) Certificate issued by ONRC with actual / current information on the date of presentation, showing that the tenderer / tenderers have as activity according to CAEN the execution of services ... details on www .e-licitatie.ro

Please note that if two or more bidders are ranked first with financial offerswith the lowest price, then the contracting authority will use the price re-application request through the SEAP facilities. Regarding the duration of the framework agreement, we mention that it is for a maximum of 48 months, but according to the provisions of the tutelage forum, the Ministry of Health may end the framework agreement at another time (within the 48 months)
