Non-compliance with the situations provided in art. 60, 164, art. 165 and art. 167 of the Law no. 98/2016

Obligatory requirement: Bidders, third parties and subcontractors must not find themselves in the situations provided for in art. 60, 164, art. 165 and art. 167 of the Law no. 98/2016. The way to prove the fulfillment of the requirement: DUAE will be filled in - by the economic operators participating in the award procedure with the information related to their situation.Article 187 (1) (h) of Law 98/2016 states that "the economic operator has been guilty of misrepresentation in the content of the information transmitted at the request of the contracting authority for the purpose of verifying the absence of grounds for exclusion or the fulfillment of the qualification criteria and selection, did not submit this information or is not able to present supporting documents to the groundAccording to the provisions of Article 167 (1) (g) of Law 98/2016, "the economic operator seriously or repeatedly breached its main obligations under a public procurement contract, of a sectoral procurement contract or a concession contract previously concluded and these violations led to the early termination of that contract, non-interests or other comparable penalties; "

Mandatory requirement:
