1. Bidders, third-party supporters and subcontractors should not find themselves in the situations provided for in Articles 164, 165, 167 of Law 98/2016. Modality demonstrating the fulfillment of the requirement: the DUAE will be filled by the economic operators participating in the procedure for associates / third partiesunder the provisions of Article 193, paragraph 1 of Law 98/2016 on Public Procurement, as subsequently amended and supplemented, as the first proof of non-compliance in exclusion situations and the fulfillment of capacity requirements . The supporting documents proving the fulfillment of the assumed ones by filling in the DUAE, valid at the moment of presentation: attests to the lack of overdue debts in respect of taxes, taxes or contributionsr to the consolidated general budget (local budget, state budget etc), respectively equivalent documents, for foreign economic operators; the criminal record of the economic operator and the members of the administrative, management or supervisory body of that economic operator or of those having the power of representation, decision or control therein as evidenced byn the certifying certificate issued by the ONRC / constitutive act; documents demonstrating that the economic operator may benefit from the derogations provided for in Article 166, paragraph 2, Article 167, paragraph 2 and Article 171 of Law No 98/2016, as well as any other editorial documents, as the case may be. be submitted, at the request of the contracting authority, only by the tenderranked number one in the intermediate rankings completed at the evaluation of the bids.
