Conditions for the participation of applicants in public procurement related to personal status under Section 32 of the Act onřejn- obstaravani

1.1. Information and formalities necessary to assess the fulfillment of the conditions of participation: The Applicant must meet the conditions under Section 32 1 of the Public Procurement Act

1.1.1. The applicant shall prove that he / she fulfills the conditions of his / her personal status under - 32 par. 2, resp. ods. 4, 5 by submitting original documents or certified true copies of the documents, by-Section 152 of the Public Procurement Act

1.1.2. Entrepreneur entered on the list of economic entities pursuant to the regulations effective until 17 April 2016 fulfillment of the conditions of part time pursuant to - 32 par. a) if, in its organizational structure, the member / members of the supervisory body and / or the procurator / procurator show the following:

1.1.2.1. according to - 32 par. a) by submitting an extract from the criminal record, more than 3 months, or

1.1.2.2. pursuant to - 152 of the Act on Public Procurement (after the change of the data in the list of economic entities and the addition of this information to the list of economic entities pursuant to Section 156 of the Public Procurement Act)

1.1.3. Agents entered on the list of economic entities pursuant to the regulations effective until 17 April 2016 fulfillment of the conditions of participation in accordance with Article 32 of the Decree. b) letter. c) Teachingas follows:

1.1.3.1. according to - 32 par. b) letter. c) no more than 3 months and no more than 3 months of affirmation of the health insurance company and the Social Insurance Company, or

1.1.3.2. pursuant to - 152 of the Act on Public Procurement (after the change of the data in the list of economic subjects and the addition of this information to the list of economic subjectsSection 1.1 of the Act on Public Procurement)

1.1.4 Applicant - economic entity with the status of a legal entity for exercising personal status according to - 32 par. 1 letter. a) the law on public procurement is obliged to submit also extract from the register of penalties for the person who is issued by the General Prosecutor's Office of the SR, not older than 3 months

The economic entity entered in the list of economicubjektov may meet the above-mentioned condition in part to show:

1.1.4.1. by submitting an original document - a copy of the criminal record of a legal person not older than 3 months in the public procurement process directly to the public procurer; or

1.1.4.2. by adding this information to the list of economic entities by means of the form of notification of the change of the data, which model of the Office for Public(hereinafter referred to as "the Office") publishes on its web site a copy of the criminal record of the legal person not older than 3 months.

1.1.5. In the case of a tenderer forming a group of contractors involved in a public procurement, proof of compliance with the conditions of part of the personal status for each member of the group is required. Completion of part time condition by- 32 par. 1 letter. e) The Procurement Act proves a member of the Group only in relation to that part of the subject of the procurement to be secured.

1.1.6 If the applicant has a place of business or has his habitual residence outside the Slovak Republic and the status of his place of business, does not issue some of the documents mentioned in - 32 par. 2 of the Act on Public Procurement or not-equivalent documents, may be replaced by an affidavit in accordance with the regulations in force in the place of business or usual residence. Conditions of participation of tenderers in public procurement related to the financial and economic status and documents for their proofing according to - 33 of the Public Procurement Act

1.1. The bidder shall submit the following original document (s) or his /their certified true copies of which prove their financial and economic standing:

1.1.1. Under - 33 par. 1 letter. a) a law on public procurement of a bank statement or branch office of a foreign bank where the applicant has opened an account, his / her ability to execute financial obligations over the last 3 years respectively; for years that are available in the dependence upon the commencement or commencement of overdraftand when the time spent in an unauthorized debete has not been determined, in case of repayment of the credit, the due date is that the applicant does not have the blocking of the account in connection with the execution of the act.

1.1.2.On the applicant's statement that he / she is only teaching me in the bank has submitted a statement by the bank (s) according to this section of the notice.

1.2.Acquisitor or interested person can prove the financial and economic statusia the financial resources of another person, regardless of their legal relationship. In such a case, the applicant or an interested contracting authority must demonstrate that, in performing the framework agreement, he / she will actually use the resources of a person whose position is to prove his / her financial and economic standing. The fact according to the second sentence is proved by the interested person or the applicant by a written contract concluded with the person, -whose sources are meant to prove their financial and economic status. From a written contract, the person's handbag must appear to provide performance during the duration of the contractual relationship. The person whose resources are to be used to prove his financial and economic status must demonstrate compliance with the terms of part-time status, except for Section 32 1 letter. e) the Public Procurement Actand I do not have to have evidence of exclusion under - 40 par. 6 sheets. (a) to (h) and 7 of the Public Procurement Act

1.3. If an applicant fails to provide the document to the contracting authority with objective evidence to prove his financial and economic status, the financial and economic position may be demonstrated by the submission of another document deemed appropriate by the contracting authority. fromthe justification of the proportionality of the conditions of the part in relation to the subject of the order and the need to include them among the conditions of the part in accordance with - 38 par. Article 5 of the Public Procurement Act: The determination of the extent of the conditions of participation relating to the financial and economic standing and the evidence to prove them shall take into account the nature, extent and complexity of the subject of the procurement. From the required document it is possible to reasonably identify the financial one-the stability of the bidders, the state of their economic and financial situation, their ability to pay and the performance of their debts to the bank. The fulfillment of the terms and conditions attached to the appraisal of the economic and financial standing of applicants to such an appropriate extent creates the presumption that the performance of the contract will be executed only by such a contractual partner as to ensure the smooth execution of the contractual obligation, the risk of non-fulfillment of contractual obligations due to economic instability. The tender documents for the public tender are published on the day of the announcement of this public procurement in the profile of the contracting authority established in the electronic file on the website www.uvo.gov.sk. The contracting authority will also publicly publish in its profile other relevant documents necessary for the preparation(eg providing explanations under - 48 of the Public Procurement Act). The contracting authority provides unlimited, complete and direct access to the contract documents and other documents free of charge. Complaints will also be provided to interested persons on the basis of a written request sent electronically or by post to the address given in Section I.1 of this notice. Such a request must be from(business name or names, location, place of business or usual residence of the applicant), contact details of the telephone number and e-mail address of the tenderer. Complaints will be sent by e-mail electronically to the address given in the application. Public Procurer pwill provide explanations of the information necessary for the preparation of the tender, a proposal for proof of fulfillment of the conditions of participation in accordance with - 48 of the Public Procurement Act and according to the tender documents. Communication between the contracting authority and the interested parties, Applicants will only be in the Slovak or Czech language. The contracting authority requires the commitment to offer security under the-Section 46 of the Public Procurement Act.

The security is set at a higher rate:

- for the part of the order no. 1: 20, 000.00 EUR (word of twenty-two euros),

- for part of the order no. 2: EUR 25 000, 00 (word of twenty-five thousand euros), - - for part of order No. 3: € 20, 000.00 (word of twenty thousand euros)

5. Under Section 66 Article 7 of the Act on Public Procurement-Section 40 of the Public Procurement Act shall be carried out after evaluation of the tender pursuant to Section 53 of the Public Procurement Act. The public contracting authority shall exclude from the public procurement of the applicant in the evaluation of the conditions of participation pursuant to - 40 of the Public Procurement Act, if, on the basis of the information provided, I believe that the tenderer has concluded a public procurement with another economic entity dan event disturbing the economy. Documents to prove the fulfillment of the conditions of participation of tenderers in public procurement specified in points III.1.1), III.1.2) and III.1.3) of this notice for the award of public service contracts may be replaced in advance by the Contractor pursuant to Section 39 of the Act on Public Procurement and the Single European Document (JED), fulfilling the requirements of - 39 par. 2 of the Act-on public procurement, i. including the updated declaration of the economic entity that: a) there is no evidence of its exclusion, b) it provides the contracting authority on request with the documents replaced by the JED, the requirements for execution, the submission of the JED and other details and information related to the JED stated in supporting materials. The contracting authority does not enter into a framework agreement with the uca jammer who is required to register with the public sector partners under Act No. 315/2016 on the register of public sector partners and on the amendment of certain laws and not entered in the register of public sector partners or subcontractors who have the obligation to register in the public sector partners register and are not entered in the register of public sector partnersTora.
