The subject of the contract is the selection of the contractor for the implementation of the services: maneuver, unloading, storing fuel, carburizing Heating Plants, waste records with the code 100101-slags, ashes and dust from boilers - in Heating Plant South at ul. 7 Żelazna St. and in the Heating District Połnoc at ul. Holszańska 3 in Radom, the scope of which has been described in detail in the Specification of the Essential Terms of the Contract ("ToR"): in Part I of the Instructions for Contractors and in Part II of the Terms of Reference - Contract (wzor) with Annexes.

1.1. Heating plant Południe TCI includes:

a) Providing shunting services at the railway siding RADPEC Południe TC I at ul. Żelazna 7 in Radom,

b) Provision of unloading services from "Fals" self-unloading wagons or "Ea" type coal wagons on the RADP railway sidingEC Południe TC I at ul. Żelazna 7 in Radom,

c) Provision of fuel storage services - coal dust at the coal square in Heating Plant South TC I at ul. Żelazna 7 in Radom,

d) Provision of carburizing services at the Heating Plant South at ul. Żelazna 7 in Radom,

e) Management of combustion waste from combustion at the Heating Plant South TC I at ul. Żelazna 7 in Radom.

F) Takeoveriązkow in the scope of waste records with the code 100101 - slag, ash and dust from boilers (keeping record cards and waste transfer cards) in the BDO system for Heating Plant South.

1.2. The Połnoc TCII heating plant includes:

a) Providing maneuvering services at the "Old Wola" railway siding Połnoc TC II at ul. Holszańska 3 in Radom,

b) Provision of unloading services from the "Ea" type coal wagonson the railway siding "Stara Wola" Połnoc TC II at ul. Holszańska 3 in Radom,

c) Provision of fuel storage services - coal dust at the coal square in Heating Plant Połnoc TC II at ul. Holszańska 3 in Radom,

d) Provision of carburizing services of the Połnoc TC II Heating Plant at ul. Holszańska 3 in Radom,

e) Management of combustion waste from combustion in the Połn Heating PlantTC II at ul. Holszańska 3 in Radom.

F) Taking over the obligations regarding the registration of waste with the code 100101-slag, ash and dust from boilers (keeping record cards and waste transfer cards) in the BDO system for the Heating Plant in the North.

The scope of work is described in detail in Part II ToR (Agreement with attachments).

1. Contractors may apply for the contract if they:

a) meet the conditions ofunions to participate in the proceedings referred to in points III.1.2) and III.1.3) of this notice, and

b) are not excluded from the procedure pursuant to art. 24 paragraph 1 point 12 23 and par. 5 points 1) and 8) of the Public Procurement Law

2. In order to confirm that there are no grounds for excluding the Contractor from the procedure, the Contractor whose bid is best rated - shall submit at the request of the Employer:

a. information fromNational Criminal Register in the scope specified in art. 24 paragraph 1 point 13, 14 and 21 of the Public Procurement Law, with the exception referred to in art. 133 section 4 of the Public Procurement Law, issued not earlier than 6 months before the deadline for submitting bids;

b. certificate of the competent head of the tax office confirming that the Contractor is not in arrears with taxes or other document confirming that the Contractor has entered intoan agreement with the competent tax authority regarding the repayment of these receivables together with any interest or fines, in particular, he obtained the exemption provided for by law, deferment or distribution in installments of overdue payments or withholding in full the execution of the decision of the competent authority issued not earlier than 3 months before the expiry of the deadline submitting offers

c. proper certificateorganizational unit of the Social Insurance Institution or Kasa Rolniczego Ubezpieczenia Społecznego or other document confirming that the Contractor is not in arrears with the payment of social security or health insurance contributions or another document confirming that the Contractor has entered into an agreement with the competent authority regarding the repayment of such receivables with any interest or fines, in particular, he obtained the exemption provided for by law, deferment or installment of overdue payments or withholding in full the execution of the decision of the competent authority, issued not earlier than 3 months before the deadline for submitting bids

d. the Contractor`s statement that he has not issued a final court judgment or final administrative decision regarding his default in paymentdocuments, fees or social security or health insurance contributions or - in the event of such a judgment or decision - documents confirming the payment of these receivables together with any interest or fines or conclusion of a binding agreement on the repayment of these receivables,

e. Contractor`s statement that he has not been awarded a preventive measure against himfor public procurement,

f. Contractor`s declaration of non-payment of local taxes and fees, referred to in the Act of 12 January 1991 on local taxes and fees,

g. an excerpt from the relevant register or from the central register and information on economic activity, if separate provisions require an entry in the register or the register, to confirm the lack of grounds forlooting based on art. 24 paragraph 5 point 1 of the Public Procurement Law

3. If the Contractor relies on the resources of other entities, as well as when he intends to entrust the implementation of part of the subcontractor`s order, he shall submit the abovementioned documents also in relation to this entity or subcontractor. Article 36ba para. 1 3 of the PPL Act shall apply accordingly.

4. If the Contractor has his place of residence or registered office outside the territory of Rof the Republic of Poland, instead of the documents referred to above, it submits other documents referred to in section VI.3. points 4-5 of this notice.

5. The Contractor whose tender is highest rated will be required to submit at the request of the Employer within the time limit indicated by him not less than 10 days, valid on the day of their submission, the statements and documents confirmcircumstances indicated in the complex / composite EAT.

1. The condition will be met if the Contractor demonstrates that:

a. is insured against civil liability in the scope of conducted operations related to the subject of the order for a sum insured of not less than PLN 10, 000, 000 (in words: ten million zlotys).

In the case of Contractors jointly applying for the award ofthe above-mentioned conditions must be met by all Contractors jointly.

2. in order to confirm that the Contractor has met the conditions of being in an economic and financial situation ensuring the performance of the contract, the Contractor shall submit:

a. documents confirming that the Contractor is insured against civil liability in the scope of conducted activities related to the subject of the contract for the sum ofnot less than PLN 10, 000, 000.00.

3. If the Contractor submits documents containing amounts given in a currency other than PLN, then for the purposes of this proceeding the Employer will convert the amounts given from a foreign currency into PLN according to the average exchange rate of PLN against foreign currencies, announced by the National Bank of Poland (Table A of exchange rates of average foreign currencies ) on the day they stayedand published a sectoral contract notice in the Official Journal of the European Union. If, on the day on which the announcement was published, the average PLN exchange rate for foreign currencies announced by the National Bank of Poland was not published, the Purchaser will take the average exchange rate from the last table before that day.

4. If, for a justified reason, the Contractor cannot provide documents regardingh the financial or economic situation required by the Employer, may submit another document which sufficiently confirms the fulfillment of the condition described by the Employer.

5. In order to confirm compliance with the conditions for participation in the proceedings, the contractor may rely on the technical or professional abilities or financial or economic situation of other entities, regardless ofthe legal nature of the legal relations that connect him with him, on the principles set out in Art. 22a of the PPL Act. The Contractor, which relies on the abilities or situation of other entities, must prove to the Employer that in carrying out the contract, he will have the necessary resources of these entities, in particular, presenting the undertaking of these entities to make available to him the necessary resourcesto process the order.

1. In order to demonstrate that the Contractor meets the conditions for participation in the procedure and is not subject to exclusion, the Contractor with the offer shall submit:

a. A declaration made in the form of a single European order document (called "EAT") valid as at the date of submission of tenders, constituting a preliminary confirmation that the Contractor is not subject to exclusion from the procedure and meets the conditionsdepartment in proceedings.

b. In the event of joint application by the Contractors, JEDZ shall be submitted by each of the Contractors.

C. EAT about other entities, if the Contractor relies on their resources.

D. EAT about subcontractors to whom the Contractor intends to entrust the performance of part of the order

- documents referred to in item a, b, c, and d above are submitted to demonstrate the absence of istating against the abovementioned entities the grounds for exclusion from participation in the procedure and compliance with the conditions for participation in the procedure (to the extent indicated in the ToR).

e. the EAT statement should be sent in electronic form with a qualified electronic signature.

2. The Contractor within 3 days of placing on the Employer`s website the information referred to in art. 86 section 5 of the ActPublic Procurement Law provides the Employer with a declaration of belonging or not belonging to the same capital group. In the case of belonging to the same capital group, the Contractor, together with submitting the statement, may provide evidence that links with another Contractor do not lead to distortion of competition in the procurement procedure.

3. When the Contractor relies on capabilities or situationsof other entities on the principles set out in art. 22a of the PPL Act, together with the offer, submits proof that during the performance of the contract he will have the necessary resources of these entities, in particular the obligation of these entities to provide him with the necessary resources at the disposal of the contract in accordance with the requirements of the ToR.

4. If the Contractor has its registered office or place of residence outsidethe territory of the Republic of Poland, instead of documents from Section III.1.1):

- point 2a) - submits information from the relevant register or, in the absence of such register, another equivalent document issued by the competent judicial or administrative authority of the country in which the Contractor has its registered office or place of order or place of order has a person to whom the information or document relates, to the extent specifiedin art. 24 paragraph 1 point 13, 14 and 21 of the Public Procurement Law (with the reservation referred to in Article 133 (4) of the Public Procurement Law)

- points 2b), 2c) and 2g) - submits a document or documents issued in the country in which the Contractor has registered office or place of residence, confirming accordingly that:

a) he is not in arrears with taxes, fees, social security or health insurance contributions or that he has entered into an agreement withauthority regarding repayment of these receivables, together with any interest or fines, in particular, he obtained the exemption provided for by law, deferment or installment of overdue payments or withholding in full the execution of the decision of the competent authority;

b) its liquidation has not been opened or bankruptcy has been declared.

5. If in the country in which the Contractor has its registered office or place of or placeOrder. has the person to whom the document relates, does not seem documents from point 4, they are replaced by a document containing, respectively, a statement by the Contractor, with an indication of the person / persons authorized to represent him, or a statement of the person to whom the document was supposed to relate, submitted to a notary or judicial authority, administrative or competent professional or economic self-government bodydue to the seat or place of order. 6. Contractor having its registered office on the territory of the Republic of Poland, in relation to a person having place of residence outside the territory of the Republic of Poland, to which the document from Section III.1.1) item 2a) submits, the document from Chapter VIII item 9 IDW.

7. The contracting authority provides for the possibility of using the procedure indicated in art. 24aa section 1 of the Public Procurement Law
