Open procedure for the assignment of the widespread canteen service for a period of 36 (thirty-six) months.

The contract concerns the assignment of the widespread canteen service for a period of 36 (thirty-six) months.

Main Site: Rome.

The contract concerns the assignment of the service of the widespread canteen service for a period of 36 (thirty-six) months, as better indicated in the Discipliof the tender and its attachments.

The exclusion from the tender as essential elements of the bid, each competitor (single company / RTI / consortium) must satisfy, also in accordance with the provisions of the tender regulations, the following conditions:

a) registration for activities concerning the services object of the tender in the register of companies or in one of the professional registers or commof the State of residence if it is an EU Member State, in accordance with the provisions of art. 83 of Legislative Decree no. 50/2016;

b) possession of the requisites envisaged by art. 144, paragraph 3 of Legislative Decree no. 50/2016;

c) there are no grounds for exclusion pursuant to art. 80 of Legislative Decree no. 50/2016

1. The supplementary provisions of this announcement - including the additional causes of exclusionand - are contained in the Disciplinare di gara and its annexes, which can be freely viewed and downloaded from the client's profile at the URL (www.amaroma.it);

2. also for the purposes of paying the contributions due - pursuant to art. 1, paragraphs 65 and 67 of the law n. 266/2005 - by the economic operators wishing to take part in the tender referred to in the present call for tenders, the code idof the tender (CIG) and the following: 7626606A5C. The payment methods can be viewed on the website (http://www.anticorruzione.it/portal/public/classic/Servizi/ServiziOnline/ServizioRiscossioneContributi );

3. all declarations, under penalty of exclusion, must be drawn up and signed in accordance with and for the effects of the D.P.R. n. 445/2000 digitally signed;

4. AMA S.p.A. reserves the following:

a) proceed with the awarding even in the presence of only one valid offer, if deemed appropriate and convenient;

b) not proceed with the awarding if no offer is convenient or suitable in relation to the contractual object;

c) suspend, reindire or not to award the tender in a justified way;

d) not to enter into a motivated contract even if the adjudicator has previously intervenedaction;

5. the competitors for which there is one of the grounds for exclusion pursuant to Legislative Decree no. 50/2016 and, in particular, pursuant to art. 80 of said legislative decree;

6. bids equal to or greater than the amount placed on the basis of bidding, as well as incomplete, partial and / or conditional bids / offers are not permitted /

7. abnormally low offers are indivi-duate and evaluated on the basis of the provisions of art. 97 of Legislative Decree no. 50/2016;

8. and subcontracting is permitted according to the provisions of art. 105 of Legislative Decree no. 50/2016;

9. information and clarifications on the tender documents can be requested, from Monday to Friday, at the General Business Area - Purchasing Service by PEC at the address indicated in point I.1, no later thanno 31.10.2018;

10. the clarifications will be sent by e-mail to those who, having downloaded the electronic version of the tender documentation, explicitly request it by specifying the data necessary to allow the submission and will be published in electronic format on the site referred to in point I.1) ;

11. communications to competitors will be made in accordance with the provisionsI am from the artt. 29, paragraph 1, and 76, paragraph 5 of Legislative Decree 50/2016 by PEC and with a specific publication on the AMA website, in the Tenders and Suppliers section,

12. it should be noted that, with reference to the contract that will be signed with the successful tenderer, the regulation on the traceability of financial flows pursuant to Law 13.8.2010, n. 136;

13. it is also specified that the contractor con which will be signed the contract, during the execution of the latter and throughout its duration, must keep constantly updated AMA in order to retain possession of the requirements required by Article 80 of Legislative Decree no. 50/2016 and s.m.i.;

14. the competitors, as part of the economic offer, must indicate their labor costs and corporate burdenshealth and safety in the workplace, pursuant to art. 95, c. 10 of Legislative Decree no. 50/2016 and s.m.i.,

15. the competitors, with the submission of offers, allow the processing of their personal data, pursuant to Legislative Decree no. 196/2003 and EU regulation 2016/679, for the competition and contractual requirements;

16. AMA does not make use of an arbitration clause which, therefore, does not exist-contractually provided for,

17. if the conditions are met, AMA can resort to the goodwill agreement, pursuant to art. 205 of Legislative Decree 50/2016;

18. this procedure has been authorized with the determination of PRE / AD no. 8/2018;
