Entrusting of the compulsory service canteens for prison police staff.

The compulsory service canteens for prison police personnel in the premises of prisons, the high school of criminal execution, training schools and of educational institutions of the territorial district of Venetor, Friuli Venezia-Giulia and Trentino Alto-Adige, delivered through the production of meals in the kitchens of the contracting administration in compliance with Annex 1 to the decree of the Ministry of the Environment and the protection of the territory and the sea of 25.7.2011, published in the Official Journal of 21.9.2011 n. 220.

Main Site: District houses of Belluno, Padua, Rovigo, Treviso, Venice, Veronaand Vicenza; prison houses in Padua and Venice.

Restaurant service with reduced environmental impact in the compulsory service canteens for prison police staff provided through the production of meals in the kitchens of the contracting administration, which are granted for use free of charge to the successful supplier. The individual activities into which the self is dividedrvizio and the methods with which the aforementioned service must be provided are indicated in the technical specifications, its annexes and appendices. The indicative number of meals that the contracting administration assumes can be consumed during the duration provided for in the main contract (1.7.2020-31.12.2022) at the delivery locations which are currently certain and listed above, and equal to: lot 1: n. 478020. The aforementioned quantity is purely indicative and not binding for the contracting administration. It should also be noted that this quantity does not include the meals of the other users possibly authorized at the institutions listed above, as well as the meals consumed at other different penitentiary institutions that may eventually be activated and the meals and breakfasts related tostudents from schools and training institutes who could possibly be activated at the request of the administration, as specified in the technical specifications. The total amount of the service that the contracting administration will pay to the supplier will be calculated by applying the price awarded to the supplier for each meal actually consumed and for each evreal breakfast actually consumed the price of 1.00 EUR.

The subjects referred to in Article 45 of Legislative Decree 50/2016 registered in the Chamber of Commerce - commercial register or other commercial register of a State can participate in this tender member for the sector of activity covered by this contract.

The participation of companies that are temporarily grouped or grouped is admittedandes and consortia with the observance of the discipline referred to in articles 45, 47 and 48, of Legislative Decree no. 50 / 2016.

It is forbidden for competitors to participate in the race individually and simultaneously in associated form (R.T.I., consortia) or to participate in more than one R.T.I. or consortium, under penalty of exclusion from the tender by the company itself and the R.T.I. o consortia to which the company partecipa.

The participation of companies that are in a situation referred to in article 2359 of the civil code or in any relationship, even in fact, if the control situation or the relationship implies that the offers are attributable to a single decision-making center.

Avaliation is admitted according to the modalities and terms provided for in article 89 of Legislative Decree 50/2016 and subsequent amendments.the details are contained in the tender specification attached to this announcement.

a) suitable bank references issued by leading credit institutions, which show the adequacy of the economic and financial capacity of the tenderer to support, in the event of an award, the execution of the service as deduced in the contract; all as better specified in the specification oftender in paragraph 7.2.1). In case of participation in associated form, cf. par. 7.2.1) tender specifications;

b) average minimum annual turnover for the 2016-2018 three-year period, excluding VAT (see par. 7.2.2_ tender specification);

c) average specific minimum annual turnover for the three-year period 2016- 2018, excluding VAT (see par. 7.2.3) tender specification).

1) This tender is announced as per resolutiona to contract of 18.2.2020 n. 6.596;

2) the tender documentation is made up of this Call and the following documents which form an integral part of it and to which reference should be made for any further details: tender specification; participation document model; DGUEe model; use declaration form; technical specifications, related appendix and annexes; integrity pact; contract scheme;

3) thecontracting administration reserves the right:

a) not to proceed with the award if none of the offers is convenient or suitable in relation to the contractual object, in compliance with the provisions of art. 95, paragraph 12 of the code;

b) to proceed with the award even in the presence of only one valid and deemed convenient offer;

c) to suspend, re-cancel or not awardthe tender reasonably;

d) not to stipulate the contract reasonably even if the award has previously taken place;

4) the administration uses an ASP-based electronic system to manage the tender procedure, as better specified in the specification tender;

5) the price may in no case exceed, under penalty of inadmissibility, the maximum limit of 5.85 EUR (five / 85), excluding VAT, for single main meal;

6) Competitors involved in objective situations detrimental to the level playing field between competitors and / or detrimental to the secrecy of the offers are excluded from the tender;

7) subcontracting is allowed within the limits and with the methods referred to in art. 105 of the code;

8) the administration, for all disputes that may arise, excludes arbitrationintending to take the ordinary judicial authority exclusively;

9) the successful company assumes all the obligations pursuant to law 13.8.2010, n. 136 and subsequent amendments;

10) the advertising costs incurred and still to be incurred by the administration for this procedure (estimated at € 15, 000.00) are reimbursed by the successful tenderer in accordance with the Ministry of Infrastructure Decree 2.12.2016;

11) due to the high number of meals overall estimated, a specific turnover limit is required for participation in the tender such as to ensure, proportionally to the value of the contract, an organization of sufficient means and financial resources to guarantee the ability to carry out the service according to the specifications required by the administration;

12) the codetender identification, also for the purposes of the contributions due, and:

13) for the purpose of demonstrating possession of the participation requirements, it applies, moreover, the provisions of paragraph 4 of article 86 of the code;

14) competitors allow the processing of their data, including personal data, pursuant to Legislative Decree no. 196/03 and subsequent amendments, for insolvency and contractual requirements;

15) the administration reserves the right to request the early execution of the contract;

16) any information and / or clarifications on the content of the tender documentation, may be requested from this contracting entity. Requests, formulated in Italian, must be sent no later than 12:00 on day 16.3.2020 (to be fixed at least 10 days before the deadline for the submission of tenders given the art.79, paragraph 3, letter a), electronically through the section of the System reserved for requests for clarifications, after registering with the system itself. General clarifications and / or corrections to tender documents will be published on the institutional website, in thesummary and calls for tenders and on the System communications area;

17) responsible for the procedure pursuant to article 31 of the code and dr. Salvatore Erminio;

18) no compensation is due to the competing companies for participating in the tender even if the same should, for any reason, be canceled or should it not be awarded.
