Entrusting of the in compulsory service canteens for prison police staff

in the compulsory service canteens for prison police personnel in the premises of prisons, the high school of criminal execution, training schools and educational institutions of the territorial district of Toscana and Umbria, delivered through the production of meals in the kitchens of the contracting administration in compliance with Annex 1 to the decree of the Ministry of the Environment and the protection of the territory and the sea of 25.7.2011, published in the Official Journal of 21.9.2011 n. 220.

Main Site: Arezzo - Florence Sollicciano - Florence Gozzini - Grosseto - Livorno with sect. dist. Gorgona— Lucca - MassaMarittima - Massa - Pisa - Pistoia - Porto Azzurro - Prato - San Gimignano - Siena - Volterra.

Restaurant service with reduced environmental impact in the compulsory service canteens for prison police staff provided through the production of meals at the administration kitchens contractor, which are granted in use free of charge to the successful tenderer.The individual activities in which the service is divided and the modalities with which the aforementioned service must be provided are indicated in the technical specifications, its annexes and appendices.

The indicative number of meals that the contracting administration assumes can be consumed during the duration foreseen by the main contract (1.7.2020-31.12.2022) at the delivery places that are currently certainand listed above, and equal to 670 000.

The aforementioned quantity is purely indicative and not binding for the contracting administration. It should also be noted that this quantity does not include the meals of the other users possibly authorized at the institutions listed above, as well as the meals consumed at other different penitentiary institutions that may eventually be activated and dand meals and breakfasts related to students of schools and training institutes that could possibly be activated at the request of the administration, as specified in the technical specifications.

The total amount of the service that the contracting administration will pay to the supplier will be calculated by applying the price awarded for each meal actually consumedthe price of EUR 1.00 to the supplier and for each breakfast actually consumed commercial register of a Member State for the sector of activity covered by this contract.

The participation of temporary undertakings is permittedneamente grouped or grouped together and consortia with the observance of the discipline referred to in articles 45, 47 and 48, of Legislative Decree no. 50 / 2016.

It is forbidden for competitors to participate in the race individually and simultaneously in associated form (R.T.I., consortia) or to participate in more than one R.T.I. or consortium, under penalty of exclusion from the tender by the company itself and the R.T.I. or consortiums in which the company participates.

The participation of companies that are in a situation referred to in article 2359 of the civil code or in any relationship, even in fact, if the control situation or the relationship entails that the offers are attributable to a single decision-making center.

The use is accepted according to the procedures and terms set forth in article 89 of theLegislative Decree 50/2016 and subsequent amendments

More details are contained in the tender specification attached to this announcement.

A) suitable bank statements issued by leading credit institutions, which indicate the adequacy of the economic and financial capacity of the competitor to to support, in case of award, the execution of the service as deduced in the contract; all as meglI specified in the tender specification in paragraph 7.2.1). In case of participation in associated form, cf. par. 7.2.1) tender specifications;

b) average minimum annual turnover for the 2016-2018 three-year period, excluding VAT (see par. 7.2.2) tender specification);

c) average minimum specific annual turnover for the three-year period 2016 -2018, excluding VAT (see par. 7.2.3) tender specification).

Levels minimi of capacity possibly required:

a) the references must be released at least for the estimated amount of the lot / s in which you participate;

b) minimum annual average turnover in the three-year period 2016-2018:

- equal to 2 000 000, 00 EUR (lot 1 Tuscany),

- equal to 932 836.00 EUR (lot 2 Umbria).

In the event of participation in several lots, the requirement will be deemed satisfied for a value at least equal to halfa (1/2) of the sum of the value of the lots for which you participate;

c) average minimum specific turnover for the three-year period 2016-2018:

- equal to 1 000 000.00 EUR (lot 1 Tuscany),

- equal to 466 418.00 EUR (lot 2 Umbria).

In the case of participation in several lots, the requirement will be deemed satisfied for a value at least equal to a quarter (1/4) of the sum of the value of the lots for which you participate .

1) This tender is announced as per the resolution to contract of 12.2.2020 n. 47;

2) the tender documentation is made up of this announcement and the following documents which form an integral part of it and to which reference should be made for any useful detail: tender specification; participation document model; DGUE model; use declaration form; technical specifications; related appendix and attachments; agreement ofintegrity; contract scheme;

3) the contracting administrator reserves:

a) not to proceed with the award if none of the offers is convenient or suitable in relation to the contractual object, in accordance with the provisions of the art. 95, paragraph 12 of the code;

b) to proceed with the award even in the presence of only one valid offer deemed convenient;

c) to suspend, re-order or not award the tender reasonably;

d) not to enter into the contract reasonably even if the award has previously taken place;

4) the administrator uses an ASP (Application service provider) telematic system to manage the tender procedure, as better specified in the tender specification;

5) the price may not exceed in any case, under penalty of inadmissibilityissibilita, the maximum limit of 5.85 EUR, excluding VAT, for each main meal;

6) competitors involved in objective situations detrimental to the level playing field between competitors and / or detrimental to the confidentiality of the offers are excluded from the tender;

7) subcontracting is allowed within the limits and with the methods set out in art. 105 of the code;

8) the administrator, for all disputes that may arise, e.g.the arbitration jurisdiction is closed, intending to bring the ordinary judicial authority exclusively;

9) the successful company assumes all the obligations of traceability of the financial flows pursuant to Law 13.8.2010, n. 136 and subsequent amendments;

10) the advertising costs incurred and still to be incurred by the administration for this procedure (estimated at EUR 10 000.00) are reimbursedby the successful tenderer in accordance with the Ministerial Decree - MIT - 2.12.2016;

11) due to the high number of meals overall estimated, a specific turnover limit is required for participation in the tender such as to ensure, proportionally to the value of the contract, an organization of means and financial resources sufficient to guarantee the capacity to carry out the service secaccording to the specifications requested by the administration;

12) the tender identification code (CIG), also for the purposes of the contributions due, and: (see point II.2.1);

13) for the purpose of demonstrating possession of the participation requirements, the provisions of paragraph 4 of article 86 of the code also apply;

14) competitors allow the processing of their data, including personal data, topursuant to Legislative Decree 196/03 and subsequent amendments, for insolvency and contractual requirements;

15) the administrator reserves the right to request the early execution of the contract;

16) any information and / or clarifications on the content of the tender documentation, may be requested from this contracting entity. Requests, formulated in Italian, must be sent no later than 12:00 on13.3.2020 (to be fixed at least 10 days before the deadline for the submission of tenders given the art.79, c. 3, letter a), electronically through the section of the system reserved for requests for clarification, after registration to the system itself. General clarifications and / or corrections to tender documents will be published on the institutional website, in the sc sectionsummary and tender notices and on the system communications area;

17) responsible for the procedure pursuant to article 31 of the code and d.ssa Anna Rosaria Massa;

18) no compensation is due to competing companies for participation the tender even if it should be canceled for any reason or should not be awarded.
