Framework agreements for the purpose of providing calibration (and calibration) and / or repair services for measuring and control equipment in the Laboratory for Electromagnetic Compatibility Testing and Radio Equipment Testing (LICETER) from ANCOM produced by Rohde & Schwarz and National Instruments and out of the perioYes warranty (CPV codes: 50410000-2 and 50433000-9), in accordance with the mandatory minimum requirements stipulated in section 2: the specifications, respectively the provision of:

Calibration services (calibration) and repair for the measurement and control equipment produced by Rohde & Schwarz and out of the warranty period (equippedit LICETER-ANCOM) (CPV codes: 50410000-2 and 50433000-9), in accordance with the mandatory minimum requirements set out in section 2: specifications.

Estimating quantities that could be requested during the framework agreement: minimum 1 ( one) calibration (calibration) operation and / or 1 (one) repair operation and a maximum of 15 (fifteen) calibration (calibration) and / or 15 (five) operationspredict) repair operations in accordance with the requirements of the specification ..

Estimating quantities that could be requested under a single subsequent contract: minimum 1 (one) calibration (calibration) and / or 1 (one) repair operations repair and a maximum of 5 (five) calibration (calibration) and / or 5 (five) repair operations in accordance with the requirements of cschedule of tasks

Estimated value without VAT of the largest subsequent contract: 377 815.00. Currency: RON.

Subsequent contracts will be awarded in such a way as to ensure the possibility of providing calibration (and calibration) and / or repair services for measuring and control equipment, at the request of the contracting authority. in the dotarea of the Laboratory for Electromagnetic Compatibility Testing and Testing of Radio Equipment (LICETER) within ANCOM produced by Rohde & Schwarz and left during the warranty period, in accordance with the provisions of the specifications.

Subsequent contracts will not be concluded. run for more than 24 months and therefore no provisions are applicablethe art. 164 para. (8) of the methodological norms for applying Law no. 98/2016, approved by GD no. 395/2016, as subsequently amended and supplemented, regarding the adjustment of prices.

The bidders and, if applicable, the third-party supporters and the subcontractors must not be found in the situations provided in art. 164, 165 and 167 of Law no. 98/2016 regarding public procurement.

Fulfillment mode:

The Single European Procurement Document (DUAE) will be completed according to art. 193-195 of Law no. 98/2016by the bidders and, if appropriate, third parties and subcontractors, with the information related to their situation.

In order to verify the information contained in the DUAE, according to art. 196 paragraph (2) of Law no. 98/2016, at the request of the contracting authority, the tenderer ranked on the first place after applying the award criterion on the admissible offers, as well as each of the associates, supporting parties, subcontractors who have completed the DUAE separately, will / will present the supporting documents proving the fulfillment of those assumed by completing the DUAE, such as:

- criminal record for the tenderer and for the persons who are members of the administration, management or management body supervision of the respective tenderer or has the power of representation, decision or controll within it, as it results from the certifying certificate issued by the ONRC / the constitutive document;

- certificates of fiscal attestation regarding the payment of taxes, taxes or contributions to the general consolidated budget, etc., from which the lack of outstanding debts at the date of presentation ;

- documents proving that the economic operator can benefit from the derogations previewed in art. 166 para. (2), art. 167 para. (2) and art. 171 of Law no. 98/2016 (if applicable);

- declaration regarding the avoidance of the conflict of interests according to art. 60 of Law no. 98/2016, regarding the persons with decision functions mentioned in the data sheet of the procurement.

For the foreign bidders, any document considered edifying in the country of origin or in the country where it is acceptedit is established, such as statements on their own responsibility, certificates, judicial records or other equivalent documents issued by the competent authorities of the respective country, accompanied by an authorized translation into Romanian.

Note: the supporting documents requested according to the above will be presented by each associate partly in case of joint bid, and in case of subcontractBoth the tenderer and the subcontractor (s), and in the case of the offer supported by the third party (s) the documents will be presented by both the tenderer and the supporting third party (s).

Requirement:

The tenderers and, if applicable, third-party supporters and subcontractors must prove the registration form under the conditions of the law, in the country of residence, from which they can prove that they are legally constituted, that they are in functionand that they have the ability to carry out the activities that are the subject of the contract.

Fulfillment mode:

The Single European Procurement Document (DUAE) will be completed according to art. 193-195 of Law no. 98/2016 by the bidders and, if applicable, by the third supporters and subcontractors.

In order to verify the information contained in the DUAE, according to art. 196 paragraph (2) of Law no. 98/2016, at the request of the contracting authority, the tenderer ranked on the first place after applying the award criterion on the admissible tenders, as well as each of the associates, third-party supporters, subcontractors who have completed the DUAE separately, will present the supporting documents proving the fulfillment of the assumed ones. by completing the DUAE, such as:

- for the Romanian economic operator:certifying certificate issued by the Trade Register Office near the competent territorial court. From the certifying certificate / register extract presented must show:

(a) the object of activity of the tenderer; the object of the contract must have a correspondent in CAEN from the certifying certificate issued by ONRC;

(b) the status of the tenderer;

(c) the persons representing the tenderin relation to third parties.

- For the foreign economic operator: the tenderer will present edifying documents, translated into Romanian by an authorized translator, real / current at the time of presentation, which will prove a form of registration as a natural / legal person or of registration / certification or professional membership and mentioning the persons representing the entity inrelations with third parties, in accordance with the legal provisions of the country where the bidder is resident. Also, the documents presented must prove that its object of activity includes activities such as those that are the subject of the public procurement and contain information on the status of the tenderer.e to present the supporting documents required according to the above, which will result in the fulfillment of the qualification criteria regarding the capacity to exercise the professional activity for the part of the contract that it performs.

A. The offers will be opened in SEAP. The bidders` representatives cannot be present at the opening;

B. The contracting authority has the obligation to requestto the bidders, in exceptional circumstances that require such extension, before the expiration of the validity period of the offer, its extension. In case of extending the validity of the offer, the participation guarantee will be properly extended. The bidder has the obligation to communicate to the contracting authority whether or not he agrees with the extension of the validity of the offer. Offer itthe economic operator who refuses to extend the period of validity of the offer and of the participation guarantee will be considered unacceptable;

C. Number of days until clarifications can be requested before the deadline for submission of tenders: 20. The contracting authority will respond clearly and completely to all requests for clarifications: on the 11th day before the deadline set.letter in the tender notice for the submission of tenders;

D. In order to view the attribution documentation uploaded in the SEAP the economic operators must have a program necessary to view the electronically signed files;

E. The ranking of the offers is established by increasing the total prices offered in Lei, without VAT, the winning bid being the one on the first place, respectiv the one with the lowest price for each lot.

In case the total prices offered in RON, without VAT, of the offers ranked on the first place are equal, the contracting authority will ask the bidders who offered the lowest total price for the deposit in SEAP of a new financial proposal, in which case the contract will be awarded to the bidder whose new financial proposal hasthe lowest total price in RON, excluding VAT, for the respective lot;

F. In the situation in which a tenderer is ranked first in the case of several lots after applying the award criterion, the supporting documents requested by the contracting authority according to art. 196 paragraph (2) of Law no. 98/2016 from which the fulfillment of the qualification criteria in accordance with flthe formations included in the DUAE will be presented in a single copy for the lots for which it is ranked in the first place, with the mention that from the supporting documents the fulfillment of the requested requirements corresponding to each lot for which the presentation of the supporting documents is requested; Details regarding the participation guarantee: the amount is:

- lot 1: 3 700 RON;

-lot 2: 4 300 RON.

Note: For several lots, the participation guarantee will be in the amount determined by adding the guarantees for the lots for which the offer is submitted. The validity period is at least 190 calendar days from the deadline for submission of tenders. All the requirements from point III.1.6.a) "Guarantee of participation" in the section regarding the Instrubids to bidders;

H. When elaborating the technical proposal, all the requirements specified in point IV.4.1) "How to submit the technical proposal" in the section on Instructions to bidders will be respected;

I. When developing the financial proposal all the requirements specified in point IV .4.2) "How to present the financial proposal" in the section on Instructionions to bidders;

J. When elaborating the offer, all the requirements specified in point IV.4.3) "The way of presenting the offer" from the section on Instructions to the bidders will be observed.
