Concluding a contract regarding the provision of consultancy and expertise services and the supply of software and hardware for the Balanced Scorecard software needed to implement the integrated system of strategic management at the level of the judiciary within the project "Dezvodevelopment and implementation of an integrated system of strategic management at the level of the judiciary - SIMS. "

1) The non-compliance of the bidders, the supporting third parties and the subcontractors is required in the situations stipulated in art. 164, art. 165 and art. 167 of Law 98/2016 on public procurement, approved, with subsequent amendments and completions. Mode of performance - presentation of DUAE, bidders will demonstrate the fulfillment of cby completing and presenting the DUAE, with information related to their situation. The supporting documents proving the fulfillment of the assumed by completing the DUAE are to be submitted, at the request of the contracting authority, only by the tenderer placed on the first place in the intermediate rankings drawn up during the evaluation of the tenders.(local budget, state budget, etc.) at the moment of presentation, - the criminal record of the economic operator and the members of the management body, the management or supervision of the respective economic operator or those having the power of representation, deccontrol or inspection, as it results from the certifying certificate issued by the ONRC / Act of incorporation, - if necessary, documents proving that the economic operator may benefit from the derogations provided in art. 166 par. (2), art. 167 par. (2), art. 171 of Public Procurement Law 98/2016, - other editorial documents, as appropriate.

If in the countryin the country of origin or in the country where the tenderer / candidate is established, no documents are issued or the documents do not cover all the situations stipulated in art. 164, 165 and 167, a declaration on his own will be accepted or, if there are no legal provisions on the declaration on his own responsibility, a genuine declaration given to a notary, an ad agency(2) The bidders, the third parties and the subcontractors must not find themselves in the situations stipulated in art. 59 60 of the Law no. 98/2016. The way to prove the fulfillment of the requirement: the DUAE will be filled in by the economic operators participating in the award procedure, withthe bands related to their situation and the Form provided by the contracting authority. The form will be presented with the DUAE.

According to the provisions of art. 193 of Law 98/2016, the contracting authority will accept in the offers of the DUAE (Single European Procurement Document), in place of the documents required to demonstrate the qualification requirements, including capacityof exercise, as preliminary evidence.
