The object of the contract is the supply of a bulldozer equipped with scarifierand winch of at least 30 t in 5-year financial leasing system, including financial leasing services, optional insurance services (CASCO) and maintenance services (periodic technical reviews) during the guarantee period.

Main Site: Direction Silvica Covasna, Ocolul Forestry Comandau, Comandau locality.

Bulldozer equipped with scarifier and winch of at least 30 t in financial leasing system on 5 aus, including financial leasing services, optional insurance services (CASCO) and maintenance services (periodic technical reviews) during the warranty period, according to the requirements of the specifications.

Quantity 1 pcs. must be found in the situations provided by art. 164, 165, 167 of Law no. 98 / 2016.

The modality by whichre can be demonstrated the fulfillment of the requirement: the DUAE will be completed by the economic operators participating in the award procedure with the information related to their situation. the bidder ranked 1st in the intermediate rankingdrawn up at the end of the evaluation of the offers.

These documents are:

- certifying certificates regarding the lack of outstanding debts regarding the payment of taxes, taxes or contributions the general consolidated budget (local budget, state budget) at the time of presentation, the foreign economic operators will submit equivalent documents issued in accordance with the legislation of the respective country,

- cashierl Judicial of the economic operator and of the members of the administrative, management or supervisory body of the respective economic operator or of those who have the power of representation, decision or control within it, as resulted from the certifying certificate issued by ONRC / the constitutive act,

- as the case may be, documents proving that the economic operator can bthe efficiency of the derogations provided in art. 166 para. (2), art. 167 para. (2), art. 171 of the Law 98/2016 on public procurement,

- other edifying documents, as the case may be.

The bidders, third parties and subcontractors must comply with the rules for avoiding the conflict of interests provided for in art. 60 of Law 98/2016 on public procurement.

A declaration is required according to art. 60 dinLaw no. 98/2016 which will be presented by all participants in the procedure once the DUAE has been filed.

The persons with decision functions within the contracting entity are: Cornea Emilian Ilie, Bocan Ioan Marcel, Vura Francisc, Burloiu Livia, Petran Mihaela-Liliana, Sinka Katalin .

Requirement no. 1.

The economic operators submitting the offer must prove a form of registration according to the lawfrom the country of residence, to show that the economic operator is legally constituted, that it is not in any of the situations of cancellation of the constitution as well as the fact that it has the professional capacity to carry out the activities covered by the contract.

The modalities by which the fulfillment can be demonstrated requirement: DUAE will be completed by the economic operators participating in the procedureattribution with the information related to their situation.

The supporting documents proving the fulfillment of those assumed by completing the DUAE, respectively a certifying certificate issued by the ONRC or, in the case of foreign bidders, equivalent documents issued in the country of residence, will be presented, at the request of the contracting authority, only by the bidder ranked 1st in the ranking iIntermediate drawn up at the end of the evaluation of the bids.

The information in the certifying certificate will contain real / current information at the date of presentation. of the validity of this offer vto be properly extended

The bidder has the obligation to inform the contracting authority whether or not he agrees with the extension of the validity period of the offer.

The bidder who does not agree with the extension of the validity period of the offer is considered to have withdrew the offer without this fact losing the guarantee of participation.

Pursuant to art. 217 of Law no. 98/ 2016 with the subsequent modifications and completions, the documents presented by the bidders are public documents. The access of any person to these can only be restricted to the extent that this information is confidential, classified or protected by an intellectual property right. According to art. 123 paragraph (1) of the GD 395/2016, the bidders will indicate the information presentedis within the procedure that are confidential, classified or protected by an intellectual property right. The indication will be made on each page of the documents in this situation. In the absence of this indication, the contracting authority will understand that the tenderer agrees with the public character of all the documents presented in the procedure.i reserves the possibility to modify the contract, without organizing a new award procedure, based on art. 221 of Law no. 98/2016
