Free Grant Award forn nurseries with a regular 4-hour program of accredited and accredited private accredited state-of-the-art elementary and gymnasium primary and private apprentice schools, UHT milk - yoghurt and bakery products: Alternative hibiscus with dried biscuits within the limit of one daily / preschool / pupil values. Lim. daily value includes the full purchase price of products, including VAT, Expense. transport, distribution and storage, as the case may be.

Supply and distribution of bakery products - alternative hook with dry biscuits for pupils from primary and secondary education, state and private, as well as preschools in kindergartens state and private programs with a normal 4-hour program, up to a daily / preschool / pupil value. Limit vThe daily price includes the full purchase price of the products, including value added tax, transport, distribution and storage costs, as appropriate.

Estimates of the minimum and maximum quantities that may be required throughout the entire framework agreement, minimum quantities = 4, 117, 680 pcs. and maximum quantities = 4 202 016 pieces

Estimated value of the largest contract subsecvent: 2 185 048, 32 RON, VAT excluded

The framework agreement will include 3 consecutive contracts, one for each school year.

1) Exclusion reasons:

The tenderers / third parties / subcontractors participating in the procedure should not find in the situations provided in art. 164, 165 and 167 of Law no. 98/2016, as subsequently amended and supplemented.

Required information and formalities-to assess compliance:

1) Non-compliance with the provisions of art. 164 of Law no. 98/2016 on public procurement, as subsequently amended and supplemented - DUAE will be filled in; 2) Non-compliance with the provisions of art. 165 of Law no. 98/2016 on public procurement, as subsequently amended and supplemented - DUAE will be filled in; 3) Non-compliance with the provisions of art. 167 ofLaw no. 98/2016 on public procurement, as subsequently amended and supplemented - DUAE will be filled in; 4) Non-compliance with the provisions of art. 59 of the Law no. 98/2016 on public procurement, with the subsequent amendments and completions - it will be completed by the DUAE.

Incorporation in the situation stipulated in art. 60 of Law 98/2016, with subsequent modifications and additions, leads to the exclusion of the offerthe procedure for the award of the framework agreement. The declaration according to art. 60 of Law 98/2016, with subsequent modifications and additions, will be presented by all participants with the submission of the DUAE. (Form 1)

In order to avoid conflicts of interest (within the meaning of Article 59 of Law 98/2016), the persons holding decision-making positions within the authority regarding the organization, -the performance and completion of the award procedure are as follows:

Mode of completion:

The DUAE will be filled in by all economic operators participating in the award procedure (bidders / associates / subcontractors / third-party supporters) with the information that characterizes their capacity. On requestcontracting authority only bidders placed after the e-auction stage on the first three places in the intermediate rankings drawn up at the end of the evaluation of the tenders will present the supporting documents proving the fulfillment of the assumed by completing the DUAE. These documents may be:

(a) certificates of non-payment of tax debts(b) the criminal record of the economic operator or of the persons having the power to represent, decide or control it within the framework of the general budget (local budget, state budget, etc.) as it results from the certifying certificate issued by the ONRC / act of incorporation, valid at the moment of presentation,

(c) as appropriate, which demonstrates that the economic operator may benefit from the derogations provided in art. 166 par. (2), art. 167 par. (2), art. 171 of Law no. 98/2016, as subsequently amended and supplemented,

(d) other editing documents, as appropriate.

The following documents will be deposited with the DUAE depositary: the firm commitment of the supportive third party to determine the effective manner in whichmaterialize its support - Form no. 2 or Form no. 3 of the subcontracting agreement / or the association agreement - Form no. 4 as appropriate. Failure to do so with the DUAE is the basis for requesting clarification of any inaccuracy in the form of the information contained in the DUAE sections of both the tenderer and the subcontractorThe economic and financial capacity of the tenderer can be sustained, in accordance with Art. 184 of the Law no. 98/2016, as amended and supplemented.

- Requirement no. 1 required to be met for Lot 1, Lot 2 and Lot 3: In-according to art. 175 par. (2) lit. a) Public Procurement Law 98/2016, with subsequent modifications and additions, bidders will have to demonstrate a minimum annual global turnover over the last 3 (three) reference years, 2015, 2016, 2017. Turnover the tenderer's annual bid for the last three years (2015, 2016, 2017) must be at a minimum:

- Lot 1: Fruitand / or vegetables - apples - 1, 800, 000.00 RON, - - Lot 2: Milk and dairy products - UHT milk and yoghurt - 3 500 000, 00 RON, - - Lot 3: Bakery products - alternative horseradish with dried biscuits - 4, 000, 000 RON.

(A) Considering that the CA will sign the framework agreement only with OP. ec. placed on the 1st, 2nd, 3rd place, as the case may be, the way of ranking the offers with equal scores will be as follows:

1) If the comihe / she finds that more than 2 admissible tenders with equal scores for the first ranked bidders have been submitted / entered into the SICAP, the CA will request the submission of new improved financial proposals (with 2 decimal places), and op. ec. will send their answer to the SICAP, in which case the framework agreement will be awarded to the first 3 bidders with the highest score; 2) If the commission findsthat more than two admissible offers with equal scores have been submitted by the second rank bidders, the way of their distribution will be made by requesting the submission to the SICAP of new improved financial proposals (with 2 decimal places), and op. ec. will send their response so that the bidder ranked first is not affected, ie the new financial proposal will not be equalor less than the ranked first place. If the new financial proposal improved as a result of the CA request, we will influence the class. the seniority will not be taken into account keeping the initial bid submitted to the SICAP in the proceedings; 3) If the commission finds that more than two admissible tenders with equal scores have been submitted by the class tenderersin the third place, the way of their classification will be made by requesting the submission to SICAP of a new improved financial proposal (with 2 decimal places), and op. ec. will send their response so that the first and second-placed bidders will not be affected, ie the new improved financial proposal presented as a result of the CA request will influence the rankings of the 1st and 2nd place, this will not be taken into account, keeping the initial bid submitted to the SICAP in the procedure. Deadlines / dates for submission of new financial proposals will be communicated in the request sent by AC,

(c) The CA will conclude a framework agreement with max 3 ops. ec. with the resumption of the competitionwith op. ec. whose offers are admissible and which are in the 1st, 2nd and 3rd place. If there are no 3 ops. ec. with admissible offers the framework agreement will end with 2 ops. ec. If there are no 2 ops. ec. with admissible offers, the framework agreement will end with 1 op. e., (d) Op. ec. ranked 1st, 2nd and 3rd, who submit a joint tender to the procedure, will present the agreementlegalized form - Form no. 4 before the contract is concluded,

(e) Any op. ec. has the right to ask for clarification or inf. Supplement, signed with the extended electronic signature, only via SICAP, within 17 days before the deadline for submitting bids, according to art. 160 par. (1) and (2) of Law 98/2016, updated. To the extent that requests for clarification or-additional information was sent within the above-mentioned deadline, AC responses will be published in the SICAP within 10 days before the deadline for submission of tenders, according to art. 160 par. (1) and (2) of Law 98/2016, updating, AC not following the request. addressed by other means of communication or other term than that established, (f) For subsequent communications depuof the tenders, the eval commission. OPEC will send the answers to the clarifications and the possible documents requested during the evaluation of the bids via SICAP (section "Questions") in electronic format, signed with the signature extended electronics.

Revision clauses are provided in the framework agreement and contractWe note that regardless of the qualification and selection criteria set by the AC and the requirements set out in the tender specifications, the nominated winning bidders have the obligation to comply with the law.
