1 network. Each offer must be secured with a deposit of PLN 16 200.00 gross

Wamay be brought in one or more of the following forms: - a) money, - b) bank guarantees or social savings and credit union guarantees, however, the surety is always a cash guarantee,

c) bank guarantees,

d) insurance guarantees

e) sureties granted by entities referred to in art. 6b (5) point 2 of the Act of 9.11.2000 onestablishment of the Polish Agency for Enterprise Development.

The bid security should be paid to the bank account of the Employer Bank Gospodarstwa Krajowego 37 1130 1189 0025 0146 2820 0003 with a description of the transfer containing the details of the proceedings and its part number. banking or socially credible savings-ka secondary, bank guarantee, insurance guarantee or sureties granted by the Polish Agency for Enterprise Development, should be submitted in the form of an original at the Ordering Party's secretariat (in the case of a separate envelope its contents should be adequately provided).

In the above case, the offer should be accompanied by the original document and a copy confirmed as true to the original of the claimsthat the original document should be attached to the offer in a way that allows its return without damage.

All documents confirming the payment of the bid bond must contain the mark and / or name of the proceedings and the correct name of the Ordering party.

The guarantee must be clearly stated, what is the manner of representation of the Guarantor. The guarantee must be signed by upan authorized (authorized) representative of the Guarantor. The signature should be made in a way that allows its identification, eg submitted with a registered stamp or legible (with the name and surname). The content of the guarantee should be unconditional, for every written request made by the Ordering Party within the binding period of the offer, the obligation of the Guarantor to pay the Ordering Party the full amount-deposit in the circumstances specified in art. 46 ust. 4a and 5 of the Act on Public Procurement Law.

2. The bid bond must be submitted not later than the set date for the submission of tenders, i.e. until the day and hour of submitting bids. The payment of a deposit in cash will be effective if it is on the Employer's bank account within the given time limit.

4. As regards the bid bond, regulations of the Order Law applypublic services included in art. 45 and 46.

5. The contractor who will not pay the bid security in the manner specified in the SIWZ will be excluded from the tender and his offer will be considered rejected. - The basis for settlements between the parties will be invoices issued in Polish at each delivery of the assortment, the contractor will pay in Polish zlotys for the correct invoice, by transfer within 30 days fromits receipt date

2. Documents confirming no grounds for exclusion of the Contractor:

2.1. Information from the National Criminal Register in the scope specified in art. 24 sec. 1 point 13, 14 of the Act, issued not earlier than 6 months before the deadline for submitting offers or applications for admission to participate in the procedure,

2.2. Information from the National Criminal Register in the scope specified in art. 24 par. 1 point 21 of the Act, issued not earlier than 6 months before the deadline for submitting bids or applications for admission to participate in the procedure,

2.3. Certificates of the competent head of the tax office confirming that the Contractor is not in arrears with the payment of taxes, issued not earlier than 3 months before the deadline for submitting offers or applications for admission to participateunder the procedure or other document confirming that the Contractor has entered into an agreement with the competent tax authority regarding repayment of such receivables with possible interest or fines, in particular obtained legally required exemption, deferral or installment payment of overdue payments or suspension in full of the decision of the competent authority ;

2.4. The proper certificatethe local organizational unit of the Social Insurance Institution or the Agricultural Social Insurance Fund or other document confirming that the Contractor is not in arrears with paying social security or health insurance contributions, issued not earlier than 3 months before the deadline for submitting bids or applications for admission to the proceedings, or another pot documentthat the Contractor has entered into an agreement with the competent authority regarding the repayment of such receivables, together with any interest or fines, in particular obtained legally permissible exemption, postponement or installment of overdue payments or suspension of execution of the decision of the competent authority in full;

2.5. Copy from the relevant register or from the Central Register and Information about WorksEconomic Operator, if separate regulations require an entry in the register or records, in order to confirm the absence of grounds for exclusion under Art. 24 sec. 5 point 1 of the Act

2.6. The Contractor's statements that he has not been the subject of a final court judgment or final administrative decision on defaulting on the payment of taxes, fees or social security or health insurance contributions, or-in the event of issuing such a verdict or decision documents confirming the payment of these claims together with any interest or fines or conclusion of a binding agreement regarding repayment of such receivables,

2.7. Contractor's statements about the lack of a ruling against him as a preventive measure for the prohibition of applying for public orders;

2.8. Contractor's attestation of not being defrayedu with the payment of taxes and local fees, referred to in the Act of 12.1.1991 on taxes and local fees (Journal of Laws of 2016, item 716),

6. If the Contractor has a registered office or place of residence outside the territory of the Republic of Poland:

6.1. It shall provide information from the relevant register or, in the absence of such a register, another equivalent document issued by the competent judicial authorityor administrative administration of the country in which the Contractor has its seat or place of residence or place of residence has the person concerned by the information or document, to the extent specified in art. 24 sec. 1 points 13, 14 and 21;

6.2. It places a document or documents issued in the country in which the Contractor has his registered office or place of residence, confirming that: a) he is not in arrears with paying taxes, t, social security or health insurance contributions or that it has entered into an agreement with the competent authority regarding the repayment of such claims together with any interest or fines, in particular it has obtained the legally required exemption, postponement or payment of overdue installments or suspension in full of the decision of the competent authority,

b) its liquidation has not been opened or announcedpadłości.

6.3. Documents referred to in point 6.1. and point 6.2 lit. b, should be issued no earlier than 6 months before the deadline for submitting bids or requests to participate in the procedure. The document referred to in point 6.2. point a, it should be issued not earlier than 3 months before the deadline expires

6.4. If in the country in which the Contractor is established or meIf the person concerned is in the place of residence or place of residence, the documents referred to in point 6.1., It is replaced by a document containing the Contractor's declaration, indicating the person or persons authorized to represent it, or a statement of the person to whom the document was to be applied, submitted to a notary or before a judicial, administrative or administrative body.m or a body of professional or economic self-government competent for the seat or place of residence of the Contractor or place of residence of that person. Provision of point 6.3. applies.

6.5. Contractor established in the territory of the Republic of Poland, in relation to a person residing outside the territory of the Republic of Poland, which is referred to in the document indicated in point 2.1.-and 2.2., submits the document referred to in point 6.1. To the extent specified in art. 24 sec. 1 points 14 and 21. If the country in which the person has a document to reside is located, no such documents are issued, it is replaced by a document containing a statement made by the notary or before a judicial, administrative or self-regulatory body, or gcompetent for the place of residence of that person. The provision of paragraph.6.2. the first sentence applies
