The bidders, the supporting third parties and the subcontractors must not find themselves in the situations stipulated in art. 59, 60, 164, 165 and 167 of Law no. 98/2016, with subsequent modifications and additions. The way in which the fulfillment of the requirement can be demonstrated: The DUAE will be completed by the participating economic operatorsand to the award procedure with the information related to their situation. With the submission of the DUAE document, the economic operators will also submit the Declaration on non-compliance in the situations provided by art. 59 60 of the Law no. 98/2016, with the subsequent amendments and completions.

The supporting documents proving the fulfillment of the assumed by the DUAE are to be submitted at the request of the authorscontracting entities, by the economic operators classified in the first two places - in the intermediate rankings drawn up at the completion of the evaluation of the offers.

These documents are:

1) certificates regarding the lack of overdue debts regarding the payment of taxes, duties or contributions to the consolidated general budget (local budget, state budget, etc.) at the moment of the presentation,

2) the criminal record-judiciary of the economic operator and of the members of the management, management or supervisory body of the economic operator or of those who have the power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / constitutive act ; 3) where appropriate, documents demonstrating that the economic operator can benefitthe derogations provided for in Art. 166 par. (2), art. 167 par. (2), art. 171 of Public Procurement Law 98/2016; 4) other editing documents, as the case may be.

Note 1: The contracting authority excludes from the award procedure any economic operator falling within any of thet. 59, 60, 164, 165 and 167 of Law no. 98 / 2006.

Note 2: In case of association, the qualification criteria for the personal situation will be met by each associate. The legal form to be taken by the group of economic operators to whom the contract has been awarded; the contracting authority reserves the right to require the legalization of the association if it has been offeredthe commune will be declared winner. Note 3: Each document will be signed by the legal representative of the bidder. If the documents are signed by another person, they will be given a power of attorney.

Documents issued in a language other than Romanian will be accompanied by an authorized translation in Romanian.

All documents will have, besides the signature, clearly mentioned the name, first nameThe third party who supports the technical and professional / economic or financial capacity of the economic operator participating in the procedure as well as the subcontractor are obliged to submit the documents listed above

All documents will be submitted to the SICAP signed with the extended electronic signature, according to art. 60 par. (4) of H.G. 395 / 2016.

When I finish evaluatingthe contracting authority will require the economic operators classified in the first 3 places, after application of the award criterion, to submit the updated supporting documents demonstrating the fulfillment of the qualification criteria according to the information contained in the DUAE Special remarks:

1) DUAE failure with the offer (including associate / subcontractor / t(...) details on www.e-licitatie.ro

AC will sign the framework agreement only with the economic operators located on the 1st and 2nd place, the way of defining the offers with equal prices to it does so:

1.1 1.1 If the commission finds that more than 2 admissible tenders with equal prices have been filed in SICAP ranked first, the authority cthe bidder will submit to the SICAP a request for clarification regarding the submission of new improved financial proposals (with 2 decimal places) and the economic operators will send their answer to the SICAP, in which case. will be awarded to the first two bidders who have the lowest price,

1.1.1 In the case of equality and after land. clarification, AC will more ground. max. 2 clarifications in Vedimproving price. If after the 3 soil. clarification regarding the submission of a new prop. financial, AC finds maintaining price equality, the respective lot is canceled,

1.1.2 The new prop. financial statement will be submitted to the SICAP signed with the extended electronic signature. Deadlines for submission of proposals. financing. will be communicated in the land transmitted to the SICAP by the AC;

1.2 If the commission finds cmore than 2 admissible offers with equal prices for op have been submitted to SICAP. ec. on the 2nd place, the way of betting will be done through the ground, in the SICAP of a new prop. (2 decimal places), and op. ec. will forward their response using the facilities provided by SICAP, so op. ec. ranked No. 1 not to be affected, respectively the new prop. financial is not equalu less than the ranked first placement;

1.2.1 If new prop. Improved financial performance of SICAP due to soil. Op. ec. participants in the award procedure (candidate, bidder, third party, subcontractor) have obthe ligation to complete DUAE, established at EU level by EC Regulation no. 7/2016, the electronic version of the document being made available as an online form by the European Commission at https://ec.europa.eu/growth/tools-databases/espd/filter. The documents are uploaded in SEAP signed with the extended electronic signature, according to art. 60 par. (4) of H.G. no. 395/2016
