Adaptation of the project according to the norms in force and technical assistance for 16 kindergartens (Bacău, Botosani, Suceava counties) ).

1. Tenderers, subcontractors and third-party supporters should not find themselves in the situations referred to in Articles 164, 165-and 167 of Law no. 98 / 2016.

The manner by which the fulfillment of the requirement can be demonstrated: the economic operators participating in the award procedure will be filled in with the information related to their situation. The supporting documents proving the fulfillment of the assumed by completing the DUAE are to be presented at the request of the contracting authority only by the bidderranked I in the mid-term ranking of the bid evaluation. These documents may be: - - certificates of absence of overdue debts related to the payment of taxes, duties or contributions to the consolidated general budget (local budget, state budget, etc.) at the moment of presentation, - the criminal record of the economic operator and organ membersmanagement or supervision of the respective economic operator, or those who have the power to represent, decide or control it within, as it results from the certifying certificate issued by the ONRC / constitutive act, - as the case may be, documents demonstrating that the economic operator may benefit from the derogations provided in art. 166 par. (2), andrt. 167 par. (2), art. 171 of Law 98/2016 on Public Procurement, - other editorial documents, as the case may be. Tenderers, third parties and subcontractors should not find themselves in the situations referred to in art. 59-60 of the Law no.98 / 2016 regarding the conflict of interests.

The classification in the situations stipulated in art. 59-60 of the Law no. 98/2016 entails the exclusion of the tenderer from the proceedingshurry to buy. Mode of accomplishment: The economic operator (Leader, Associate, Terresturator, Subcontractor) will fill in the request in the DUAE form and will present together with the DUAE and the Declaration of Interest Conflict (Form 4) in the corresponding wording section by the deadline for submission of tenders. Economic and financial capacity of the economic operator can be sustained according to art.184 of the Law no.98 / 2016.

The contract will be concluded within the limits of the approved commitment appropriations for the current budget exercise.

To view doof the awarding procedure uploaded to SEAP, it is necessary for the economic operators to hold / install on the workstation the application that allows checking the electronic signature and viewing the electronically signed documents (available on the websites of the electronic signature providers). If, after determining the final ranking according to the award criterion, the evaluation committeefinds that there are two or more bids with the same price, the contracting authority will ask for clarification through SEAP, for electronic loading by the respective economic operators of documents containing new prices. As part of the SEAP referral process, bidders have an obligation to improve or maintain the initial offer submitted to SEAP. IIf the tenderers do not submit the new offers in accordance with the contracting authority's requests or the submitted offers are no more advantageous than the initial ones or at least at their level, the contracting authority will reject the respective offers as non-conforming. During the re-routing process, the contracting authority may request clarification regarding the docthe receipts received from the bidders, the provisions of par. (1) art. 136 of H.G. 395/2016.
