Purchase of fresh fruit (apples) for the period 2018 2021

Purchase of fresh fruit (apples) to be distributed to pupils in grades I VIII from state and private education, as well as from preschools in state and private kindergartens with a normal 4-hour program, in 2018 2021, within a wavedaily / pre-school / pupil. The daily limit value includes the full purchase price of the products, excluding VAT, their transport, distribution and storage costs, as the case may be.

Lot 1 (zone-South):

- minimal quantity = 4, 743, 615 units and maximum quantity = 5, 270, 684 units

Frame Agreement: minimum value: RON 2, 590, 013.79; maximum value: 2 877 793, 45 RON

Estimates of minimum and maximum quantities that could be subject to a single subcontract, out of the total amount to be awarded during the framework agreement: minimum quantity: 527 070 pieces and max. .: 585, 632 buhow many. The value of the largest subsequent contract: 319 755, 07 RON without VAT.

The estimated value (5 270 684 pieces x 0, 546 RON without VAT) was established on the basis of the number of pupils who can benefit from the program (school year 2018 2019: 29 509 preschools and pupils, school year 2019 2020: 29 269 preschoolers and pupils, school year 2020 2021: 29 147 preschoolers and pupils)

Requirement 1.

Tenderers / Supportersi / The subcontractors participating in the procedure must not be in the situations provided by art. 164, art. 165 and art. 167 of Law no. 98/2016, as amended and supplemented

Information and formalities necessary for evaluating if requirements are met:

1) Non-compliance with the provisions of art. 164 of Law no. 98/2016 on public procurement, as last amended and supplemented- 2) Failure to comply with the provisions of Art. 165 of Law no. 98/2016 on public procurement, with the subsequent amendments and completions - it will be supplemented by DUAE; 3) Non-compliance with the provisions of art. 167 of Law no. 98/2016 on public procurement, as subsequently amended and supplemented - DUAE will be filled in; 4) Non-compliance with the provisions of art. 59 of the Law no. 98/ 2016 on Public Procurement, as subsequently amended and supplemented - will be completed with the DUAE.

Incorporation in the situation stipulated in art. 59 of the Law no. 98/2016, as subsequently amended and supplemented, results in the exclusion of the bidder from the framework agreement award procedure. The declaration according to art. 60 of Law no. 98/2016, as amended and supplemented, will be presentedby all the participants, with the submission of the DUAE.

The way of accomplishing:

The UAE will be filled by all the economic operators participating in the awarding procedure (tenderers / subcontractors / third-party supporters) with the information that characterizes their capability. At the request of the authorityonly bidders placed on the first 3 places in the interim ranking after the completion of the electronic auction stage will present the supporting documents proving the fulfillment of the undertaken by completing the DUAE. These documents may be: (a) Statutory certificates on the absence of debts in respect of the payment of taxes, duties or contributions to the budget(local budget, state budget, etc.) at the moment of presentation; (b) The judicial record of that economic operator or those having the power of representation, decision or control within it, as evidenced by the certifying certificate issued by the ONRC / instrument of incorporation, (c) where appropriate, documents demonstrating that the economic operator can benefit-by the derogations provided for in art. 166 par. (2), art. 167 par. (2), art. 171 of Law no. 98/2016, as subsequently amended and supplemented, (d) other editing documents, as appropriate.

Requirement no. 1: Mediof the total bidder's turnover over the last 3 years, 2015, 2016, 2017, respectively, must be at least equal to:

- Lot 1: South Zone - 319 755, 07 RON, - Lot 2: North Zone - 329 265, 85 RON (estimated value of the largest subsequent contract)

(a) Considering that the CA will sign the framework agreement only with economic operators placed in the 1st, 2nd, 3rd place, as the case may be, the way of biddingtheir equal scores will be as follows:

1) If the commission finds that more than 2 admissible offers with equal scores have been deposited / entered in the SICAP, the AC will request the submission of new financial proposals improved (with 2 decimal places) and economic operators will submit their response to the SICAP, in which case the framework agreement will be awarded to the first three(2) If the commission finds that more than two admissible tenders with equal scores have been submitted by the second rank bidders, the way of their classification will be made by applying for the submission in SICAP of new improved financial proposals (with 2 decimal places), and economic operators will forward their response so that the bidderand the new financial proposal will not be equal to or less than the first ranked bid. If the new financial proposal, improved as a result of the CA request, will affect the rankings of the top positions, it will not be affected will not be taken into consideration, keeping the initial bid submitted in the SICAP in the proceedings; 3) If the commission constprovided that more than 2 admissible tenders with equal scores were submitted by the third-ranked bidders, the way they will be allocated will be by requesting the submission to the SICAP of a new improved financial proposal (with 2 decimal places) and the economic operators they will send their reply so that the bidders ranked first and second place are not affected, an improved financial challenge presented as a result of the CA request will influence the rankings of Sections I and II, this will not be considered, keeping the initial bid submitted in the SICAP in the procedure. Deadlines / dates for submission of new financial proposals will be communicated in the request sent by AC,

(c) The CA will conclude a framework agreement with a maximum of 3 economic operators with the resumption of the competition, respectively with the economic operators whose tenders are admissible and which rank in the 1st, 2nd and 3rd place . If there are no 3 economic operators with admissible offers, the framework agreement will be concluded with 2 economic operators. If there are no 2 operators-(d) The economic operators, placed on the 1st, 2nd and 3rd place, who submit a joint tender for the procedure, shall present the legalized Association Agreement - Form no. 4, prior to the conclusion of the contract;

(e) For further communications subsequent to the submission of tenders, the evaluation committee will forward the clarification requests andThe economic operators will send the answers to the clarifications and any documents requested during the evaluation of the bids via the SICAP (Section "Questions"), in electronic format, signed with the extended electronic signature.
