Requests for exclusion reasons. Participating economic operators (sole bidder, leader, associate, third party, subcontractor) should not be found in the situations provided by art. 164, 165 and 167 of Law no. 98/2016. The participating economic operator has the obligation to complete and initially present the DUAE as the first proof of non-compliancein situations of exclusion and meeting capacity requirements, please consult the DUAE User's Guide developed by ANAP, available at www.anap.gov.ro

The supporting documents demonstrating the fulfillment of the undertaken by completing the DUAE are to be presented at the request of the Authority only by the bidder ranked first, after applying the atr criterionibuire, according to art. 196 of Law no. 98 / 2016.

Requirement no. 1: The economic operator or any person who is a member of the board of directors / management, supervisory or supervisory bodies of the latter, or who has power of representation, decision-making or control within it, is not in any of the situations mentioned in art. 164 par. (1) of the Law no. 98/2016, on the groundsexclusion on criminal convictions. The contracting authority has the right, according to the provisions of art. 166 par. (1) of the Law no. 98/2016, in exceptional circumstances and for overriding reasons of general interest, such as public health or environmental protection, not to exclude an economic operator in the above situations.

Justifying documents: the criminal record of the ec operatoronomic and of the members of the management, management or supervisory body of the respective economic entity or of those having the power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / constitutive act, or other equivalent documents issued by the competent authorities issued by that country to foreign bidders.

Cerinta nr. 2: The economic operator is not in any of the situations mentioned in art. 165 par. (1) and paragraph (2) of the Law no. 98/2016, on the grounds for exclusion regarding the payment of taxes or social security contributions. Exclusion grounds for breaching obligations to pay taxes, taxes and contributions to the state budget (referred to in art. 165 alinto the. (1) and paragraph (2) of the Law no. 98/2016) shall apply to economic operators for whom this infringement has been established by a judgment or administrative decision having a final and binding character, in accordance with the law of the State in which the economic operator is established or for which the contracting authority can demonstrate, the situation ofbreach of obligations to pay taxes, duties, or contributions to the consolidated general budget. The economic operator is not excluded from the procedure if he has paid these obligations or has waived his obligations through other means of extinguishment or benefits from the payment of payment or other facilities for extinguishing these obligations under the conditions specified in art. 165 par. (3) of the Acta no. 98/2016, before the contracting authority formulates the exclusion decision.

By way of exception to the provisions of art. 165 par. (1) and (2), an economic operator shall not be excluded from the award procedure when the amount of taxes, contributions and contributions to the general government due and outstanding is less than RON 10, 000. For calculating the average business denominated in a currency other than the euro will use the average annual leu / currency rate communicated by the NBR for each year.that the contracting authority will sign the framework agreement with a maximum of 2 economic operators, namely places 1 and 2, the way of bidding with equal prices will be as follows:

1) If the bids ranked first in the intermediate rankings equal prices, the contracting authority will request re-offer via SEAP, in order to divide the bids;that the second ranked bidders in the middle class have equal prices, the contracting authority will request the re-offer via SEAP, in order to divide the bids;

3) If after re-offerment the bid prices are equal, the contracting authority will ask for a new offer The price can not be improved until afterthe price offered by the previous ranked operator. In the event that the new improved financial proposal submitted to the SEAP, as a result of the request of the contracting authority received through the SEAP, will influence the rankings of the ranked first, this will not be taken into account keeping the initial SEPA bid; 4) If the Promissory Vendor clausesvillage on the 1st place refuses to conclude the subsequent contract, does not constitute the guarantee of good execution within the specified term or does not provide the products according to the technical specifications to which it has been hired, although the contracting authority has signaled the reasons for the non-conformity of the supplied products and the promising supplier did not solve the problems, the contracting party has the right to move to uthe lessor included in the framework agreement for the conclusion of the future subsequent contracts, observing the pre-notification deadlines, respectively 3 working days; 5) If the promising supplier ranked second refuses to conclude the subsequent contract, it does not constitute the guarantee of good execution in the term specified or does not provide products according to the technical specifications at which- the employee, the framework agreement concluded with the two promising operators will be terminated in advance, with the issuance of a document certifying the non-fulfillment of the contractual obligations by the contractor / contractors; 6) Subsequent contracts will be concluded according to the needs and the budget allocated with the operator ranked 1st. The contracting authority will continue the assignment procedureeven if there is only one economic operator with the admissible bid on the lot and the framework agreement will be concluded only with that economic operator.

The bidders have the obligation to file a declaration on their own responsibility indicating which documents from the offer considered as confidential, in accordance with the provisions of art. 57 par.
