1) Bidders, supportive third partiesand subcontractors should not be found in the situations referred to in art. 164, 165, 167 of Law no. 98 / 2016.

The DUAE will be filled in.

The contracting authority will ask the tenderer ranked I in the intermediate rankings drawn up at the completion of the tender evaluation the following supporting documents:

- a certificate issued by the Local Public Finance Administration of the Agency-National Fiscal Administration. The tax certificate must certify that there is no outstanding debt in respect of the payment of taxes, duties or contributions to the general consolidated budget at the time of presentation. The way of accomplishment and the applicability in the procedure: a legible copy signed and stamped by the legal representative with the mention "According to the original",

- certificate elipicked by the Local Taxes and Taxes Directorate. The tax certificate must certify that there are no outstanding debts, taxes or contributions to the local budget at the time of presentation. Filantropia Clinical Hospital, as a contracting authority, will require tenderers to submit supporting documents proving the form of registration as a natural or legal person and, as the case may be, attestation or professional membership in accordance with the provisions of the country in which the tenderer is established

Documents required to meet this criterion of caltering (specific documents by which this information can be confirmed):

Requirement no. 1:

Economic operators submitting a tender must prove a form of registration in accordance with the law of the country of residence, showing that the economic operator is legally constituted, is not in any of the situations of cancellation of the establishment and that has the capacity of profto carry out the activities covered by the contract. It will be completed by the economic operators participating in the award procedure with the information related to their situation. The contracting authority will request the supporting documents proving the fulfillment of the undertaken by completing the DUAE, respectively the certifying certificate issued by the ONRC or, in the case of the tenderersthe equivalent documents issued in the country of residence shall be submitted, at the request of the contracting authority, only by the tenderer placed on the first place in the ranking drawn up at the end of the evaluation of the tenders. 2:

The contracting authority will request the supporting documents proving the fulfillment of the obligations assumed by completing the DUAE.

Documents justifywhich proves the fulfillment of the assumed by completing the DUAE, respectively the proof of the approval of the functioning of the unit for importing, marketing and storage of medical devices by presenting the Functional Notice issued by the Ministry of Health (GD no 54/2009 regarding the conditions of placing devices on the market medical - Article 9, Article 11 and Article 14) - copy lizin the case of foreign tenderers, equivalent documents issued in the country of residence are to be presented at the request of the contracting authority to the tenderer placed on the first place in the ranking drawn up at the completion of the evaluation of the offers within validity as of the date of its submission, in a legible copy signed and stamped for "compliance with the original"to the legal representative of the firm.

If two or more offers are placed on the first place, the contracting authority will ask the bidders to submit a new financial proposal. The referral will be done through SEAP in the form of signed signature files.

Any document issued in another language will be accompanied by an authorized translationin Romanian.
