Framework agreement for air passenger services

Services provided by specialized legal entities for the purchase by the contracting authority of the airline tickets for international flights, according to its specific needs. .

Frequency and vthe nature of the contracts to be awarded: the subsequent contracts will be awarded following the re-offer for each particular trip (one or more tickets / travel) described in the specifications, as a rule daily. The estimated value without VAT of the largest subsequent contract that is expected to be awarded during the framework agreement, according to the 2019 historical, isand from 122 284.80 RON. Estimates of the minimum and maximum quantities of services that might be required:

1) during the entire framework agreement, for international air passenger transport services, the purchase of a minimum number of 1, 410 tickets and a maximum of 5, 640 tickets is estimated;

2) for a single subsequent contract of the ones to be awarded during the term of the agreementru, for the international passenger air transport services it is estimated that the purchase of a minimum number of 1 ticket and a maximum of 22. Tickets. 164, 165 and 167 of Law no. 98/2016 regarding public procurement.

For the purposes of the provisions of art. 63 paragraph (1) of Law no.98/2016 regarding public procurement, the persons with decision-making functions within the contracting authority are the following: Zisu Catalin-Stefanita, Cristea Ionel, Vasile Bogdan, Raduslav Florin, Stefan Cristina, Furdui Ioan, Petrica Stelian, Paun Nicoleta, Scarlatescu Ionela-Catalina, Ion Ana-Maria, Mancas Andreea-Nicoleta, Nita Mihaela-Monica.

Method of fulfillment: the Document will be completedSingle European Procurement (DUAE) according to art. 193-195 of Law no. 98/2016 and according to ANAP Notification no. 240/2016 by the bidders and, if appropriate, third parties and subcontractors, with the information related to their situation.is to the bidders ranked on the first 10 places in the intermediate ranking drawn up at the end of the evaluation of the bids. These documents can be:

- criminal record for the tenderer and for the persons who are members of the administration, management or supervisory body of the respective tenderer or have the power of representation, decision or control within it, as it results din the certifying certificate issued by ONRC / the constitutive document,

- certifying certificates regarding the lack of outstanding debts regarding the payment of taxes, taxes or contributions to the general consolidated budget (state budget, local budget, etc.) valid at the time of presentation,

- documents through which proves that the economic operator can benefit from the derogations provided in art. 166 paragraph (2), art. 167 para. (2) and art. 171 of Law no. 98/2016 (if applicable),

- declaration regarding the avoidance of the conflict of interests according to art. 60 of Law no. 98/2016, regarding the persons with decision functions mentioned in the data sheet of the acquisition. For foreign bidders, any document considered edifying in the country of origin or in the country where it is stable is acceptedit, such as statements on their own responsibility, certificates, court records or other equivalent documents issued by the competent authorities of the respective country, accompanied by an authorized translation into Romanian.

Note: the supporting documents requested according to the above will be presented by each associate partly in case of common offer, and in case of subcontracting so offerert, as well as the subcontractor / s, and in the case of the offer supported by the third party (s), the documents will be presented by both the bidder and the third party (s).

A) Registration: the bidders and, if applicable, the third parties and the subcontractors must prove the registration form under the conditions of the law, in the country of residence, from which they can be legally constituted, that they are in operation and thathave the ability to carry out the activities covered by the framework agreement. Method of fulfillment: the Single European Procurement Document (DUAE) will be completed according to art. 193-195 of Law no. 98/2016 and according to ANAP Notification no. 240/2016 by the bidders and, if appropriate, by third party supporters and subcontractors. The supporting documents proving the fulfillment of those they assumeprovided by completing the DUAE, it will be presented, at the request of the contracting authority, only by the bidders ranked on the first 10 places in the intermediate ranking drawn up at the end of the evaluation of the bids. These documents can be: for the Romanian economic operator: certifying certificate issued by the Trade Register Office from the competent territorial Court. When 2 or more offers have the same value of the financial proposal and are ranked on the same instead, the contracting authority will conclude the framework agreement with all the economic operators classified on the places related to the maximum number established in the participation announcement.Subsequent is attributed by the resumption of competition between the economic operators who have signed the framework agreement, for the destinations / classes / number of persons / travel conditions established by the contracting authority in the resumption of competition. The assignment of the subsequent contracts will be performed in compliance with the elements / conditions provided in the framework agreement, by resuming the competitionwhenever the necessity arises of organizing trips abroad of the personnel or the delegates of the contracting authority. In the awarding phase of the subsequent contracts by resuming the competition between the economic operators that have signed the framework agreement, the main element of the financial proposal is the lowest price of the air transport services (tickets)on) for the requested destinations (calculated as the amount of the ticket price, the value of the flight fees related to TS), in compliance with the requirements specified in the invitation to participate. The financial proposal will be expressed in euros and the payment will be made by the contracting authority in RON equivalent, at the average rate displayed by B.N.R. from the date of issue of each air ticket. In case chas in the procedure of awarding the subsequent contracts 2 or more bidders presents a financial proposal of the same value, the contracting authority will ask them a new financial proposal, the subsequent contract will be awarded to the tenderer who submitted the best offer, respectively the most low price of air transport services (calculated as the sum of the priceticket the value of the flight taxes related to TS).
