Within the framework of this order, the implementation of two independent Partial Orders was planned:

Main Site : Biała Podlaska, ul. Brzegowa 4, POLAND

Under this order, the implementation of: 1) Ordere Partial No. 1 delivery of agricultural traction tractor with accessories

a. agricultural tractor pcs. 1, and

(i). front loader pcs. 1

(ii). snow plow to the loader, item 1

(iii). spoon with euro frame min 2 100 mm pcs. 1. A detailed description of the subject of the order is presented in Part III. Description of the Subject of the Order in the SIWZ.

1. Contractors who do not take part in the proceedings may participate in the proceedingsthey are excluded from the proceedings for ordering in the circumstances referred to in Article 24 sec. 1 and par. 5 points 1) and 8) of the PPL; and who meet the conditions for participation in the proceedings regarding:

1). Competences or entitlements to conduct a specific professional activity, if it results from separate regulations, - the Employer does not set specific requirements regarding this condition.

2. In order to demonstrate the absence of grounds for exclusion from the proceedings, the contractor will submit:

a) information from the National Criminal Register in the scope specified in art. 24 sec. 1 items 13, 14 and 21 of the Public Procurement Law and, regarding a conviction for a prison sentence, to the extent specified by the ordering party pursuant to art. 24 sec. 5 points 5 and 6 of the Public Procurement Law, issued not earlier than 6 months before the expiry of these(b) a statement from the competent head of the tax office confirming that the Contractor is not in arrears with the payment of taxes, issued not earlier than 3 months before the deadline for submission of tenders or applications for admission to participate, or other document confirming that the contractor has contractedplace with the competent tax authority repayment of such receivables along with any interest or fines, in particular obtained legally permissible, postponement or installment payment of overdue payments or suspension in full of the decision of the competent authority; c) certificate of the relevant organizational unit of the Insurance Institution Social or Agricultural FundsSocial Security or other document confirming that the Contractor is not in arrears with payment of social security or health insurance contributions, issued no earlier than 3 months before the deadline for submitting bids or applications for admission to participate in the proceedings, or other document confirming that the contractor has concluded an agreement with the competent authority regarding repaymentsthese receivables, together with any interest or fines, in particular obtained the legally required exemption, deferral or payment in installments of overdue payments or suspension in full of the decision of the competent authority; d) excerpt from the relevant register or from central records and business information, if separate regulations require an entry in the register or records, -to confirm the absence of grounds for exclusion under Art. 24 sec. 5 point 1 of the Act;

e) the Contractor's declaration of affiliation or lack of belonging to the same capital group,

3. If the Contractor is established or resides outside the territory of the Republic of Poland, instead of the documents referred to in point 10.3.4) .b) - d) submit a document or documents issued to the country into which he has his registered office or place of residence, confirming that: a) he is not in arrears with taxes, fees, social security or health insurance contributions or that he has entered into an agreement with the competent authority regarding the repayment of such receivables with any interest or fines, of particularity, he obtained the legally required exemption, postponement or installment payment of overdue paymentsor backtracking in full the decision of the competent authority,

b) In the scope of point 10.3.4). a document or documents issued in the country in which the contractor has its registered office or place of residence, confirming that its liquidation has not been opened or the bankruptcy has been declared ;

2). Documents referred to in point 10.3.4) b) / d) should be issued no earlier than 3 months before the deadlinesubmitting offers;

3). The document referred to in point 10.3.4.a) should be issued not earlier than 6 months before the deadline for the submission of offers.

Contractors who are not subject to exclusion from the procurement procedure in the circumstances referred to in Art. 24 sec.1 and paragraph 5 point 1) and 8) of the PPL; and who meet the conditions for participation in progressregarding:

2). Economic or financial situation, - the contractor is to demonstrate that: a) he is insured against civil liability in respect of his business related to the subject of the order for an amount of at least - (i). Partial Order No. 1 supply of agricultural traction tractor with accessories - PLN 200, 000.00 (in words: two hundred thousand zlotys); - (ii). Partial Order No. 2 dostawa dump trailers - 60, 000.00 PLN (in words: sixty thousand zlotys);

b) has financial resources or has a credit capacity of at least - (i) Partial Order No. 1 supply of agricultural traction tractor with accessories - 200, 000.00 PLN (say: two hundred thousand PLN);

(ii) Partial Order No. 2 delivery of dump trailers - PLN 60, 000.00 (in words: sixthtens of thousands PLN);

the Contractor will submit:

a) a document confirming that the Contractor is insured against civil liability in respect of the business related to the subject of the order

b) information of the bank or cooperative savings and credit bank issued not earlier than 1 month before expiry the deadline for submitting offers confirming the possession of financial resources in theamount or the Contractor's creditworthiness in the required amount;

1. Based on Article. 24aa. Public Procurement Law The Purchaser will first evaluate the offers and then examine whether the Contractor whose Offer has been rated as the most advantageous is not subject to exclusion and meets the conditions for participation in the procedure. In order to confirm the lack of grounds for exclusion of the Contractor based onawie art 24 sec. 1, item 23 of the Public Procurement Law, in accordance with art. 24, para. 11 of the PZP Act by the Contractor, within 3 days from the day of submitting the information referred to: art. 51 par. 1a, art. 57 par. 1 or art. 60d para. 1 of the Public Procurement Law, or from posting information on the website referred to in art. 86 par. 5 of the Public Procurement Law, submits to the Ordering Party a declaration of belonging or non-membershipto the same capital group, drawn up on the basis of the template constituting Annex 5. Together with the submission of the statement, the contractor may provide evidence that links with another contractor do not lead to distortion of competition in the procurement procedure. Contractor in connection with art. 13 para. 1 and 2 of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27.4.2016 on comp(i) the protection of natural persons in relation to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46 / EC (general data protection regulation) (OJ L 119, 4.5.2016, p. 1), further "RODO", make a declaration on the fulfillment of the information obligations provided for in Article 13 or Article 14 of the GDPR, based on the formulaego attachment No. 6
