Service market aimed at the maintenance of the surroundings of various social housing complexes in Molenbeek-Saint-Jean and the work of people with disabilities

The contract aims at the conclusion of a service contract with a duration of four years, within the meaning of l`article 2, 22 of the law of 17.6.2016, having as its object the maintenance of the surroundings of various social housing complexes, as well as their collective gardens and certain private gardens.

The market aims at the conclusion of a service contract with a duration of four years.

Without prejudice to theapplication of the article seventy of law of 17.6.2016, the tenderers cannot be in one of the grounds of exclusion referred to in articles sixty-seven to sixty-nine of the law of 17.6.2016. Tenderers will complete the ESPD (Single document for European markets) (http://eur-lex.europa.eu/legal-content/FR/TXT/qid=1498470834586&uri=CELEX:32016R0007). They will append to iti: compliance with Art. sixty-eight of the law of 17.6. 2016 and Art. Sixty-two of the decree: The tenderer employing staff subject to the law of 27.6.1969 attaches to his request to participate a certificate from the National Social Security Office which it follows that is in good standing with regard to payment of social security contributions. The bidder employing the personl coming from another Member State of the European Union and which is not referred to above, encloses a certificate issued by the competent authority certifying that it is in good standing with its obligations relating to the payment of security contributions social security according to the legal provisions of the country where it is established.

The certificate relates to the last calendar quarter elapsed before the deadline for receiption of offers. Respect for Art. sixty-eight of the law of 17.6.2016 Art. sixty-three of the decree: the tenderer attaches to his request to participate a certificate which shows that he is in good standing in relation to his professional tax obligations according to the legal provisions of the country where it is established. The certificate relates to the last fiscal period elapsed before the date limite of reception of the offers.

For a Belgian tenderer, the attestation must emanate from the SPF Finances. Any corrective measures referred to in Art. seventy of the law of 17.6.2016. By signing the ESPD, the tenderer: declares on his honor that he is in possession and undertakes to supply, on simple request from the contracting authority, within ten days, the documents below (thesedocuments will be requested in the event that the tenderer enters into consideration for the award of the contract). Criminal record, extract from the criminal record or equivalent document issued by a competent judicial or administrative authority of the country concerned. The statutes and acts of society designating all the members having a decision-making power within the company. Case extractsier judicial or equivalent document issued by a competent judicial or administrative authority of the country concerned of each natural person having a power of decision designated by the statutes and acts of companies must be communicated. Certificate attesting to the absence of bankruptcy. A certificate issued by the competent authority of the country concerned attesting that the tenderer is notnot in a state of bankruptcy, liquidation, cessation of activities, judicial reorganization or has not admitted its bankruptcy or has not been the subject of a liquidation or judicial reorganization procedure, or in any similar situation resulting from a similar procedure existing in other national regulations. For the documents listed in points A /, B / and 2, theContracting authority will make use of Telemarc, and they will only be requested from tenderers if they cannot be obtained through this means.
