Information and Publicity Service Contract within the project My SMIS 116950 "Strengthening Capacity for Adaptation Management of Natural Capital of Retezat National Park" (including reservations 2, 449 Twins, 2, 496 Zeicul Cave) together with overlapping Natura 2000 sites partly - ROSCI0217 Retezat and ROSPA0084 Retezat Mountains

The contracting authority will excludeat any time of the procedure for the award of the service contract, any economic operator who is in one of the situations referred to in art. 60, 164, 165 and 167 of Law 98/2016 on Public Procurement. The exclusion reasons will also apply to associations / subcontractors / third-party supporters, as appropriate. Mode of accomplishment: Under the sanction of rejection of the offer as in(bidder, affiliate tenderer, subcontractor, third party, as the case may be) will present with the offer both the DUAE filled in with the information related to their situation and the declaration on their own responsibility regarding the non-compliance with the provisions art. 60 of Law no. 98/2016. At the same time, failure to comply with the DUAE, if applicable, the firm commitment of the third party to support the effective manner in which its support will materialize is a basis for requesting clarification of any inadvertent form of information contained in the DUAE sections of both the bidder and the subcontractor /, this being necessary to ensure the deploymentcorresponding area of the award procedure. The supporting documents proving the fulfillment of the undertaken by completing the DUAE shall be submitted, only at the request of the contracting authority, to the first ranked bidder after applying the award criterion to the admissible tenders. The supporting documents may be:

- founding certificates regarding the lack of debts res(local budget, state budget, etc.) at the time of submission,

the criminal record of the economic operator and of the members of the management, management or supervisory body of the that economic operator or those having the power of representation, decision-making or control within it, as it results from the certifying certificate issued by the ONRC / constituent act, - if necessary, documents proving that the economic operator may benefit from the derogations provided in art. 166 par. (2), art. 167 par. (2), art. 171 of the Public Procurement Law 98/2016, - other editorial documents, as the case may be.

Documents requested will be presented in Romanian / language in-which were issued accompanied by the translation into Romanian, as the case may be. The decision-makers of the contracting authority are: Zoran Acimov, Buian Gheorghe Gabriel, Nicoara Alexandru-Dorin.

The decision-makers of the auxiliary procurement services provider: S.C. Procurement Expert Company S.R.L., administrator: Pop Anca. Prior to awarding the contract, -the economic operator who will rank first after applying the award criterion will submit to SEAP updated supporting documents demonstrating that all qualification criteria are met, according to the information contained in the DUAE.

Economic operators submitting a tender must prove a form of registration under the law of the country of residence, from which the economic operator (tenderer / associated tenderer), is legally constituted, that it is not in any of the situations of cancellation of the constitution and the fact thathas the professional capacity to perform the activities that are the object of the contract.

Mode of accomplishment: The DUAE will be presented in accordance with the provisions of art. 193 par. (1) of Law 98/2016. Where: P = Total score P1 = The value for the valuation factor "Value bid in lei without VAT" - P2 = P2 Quality of the technical offer "Demonstration of an appropriate methodology for implementing the contract, as well as adequate planning of resources and activities", - P3 = The score for fa valuation actor "Experience of the Expert Team."
