The following minimum qualification requirements are required:

1. The evaluation commission has the right to request completions / clarifications to the submitted offers.

2. If there are offers on the 1st place what presents an equal price, it will be requested to re-offer in SICAP in order to split the offers.

If there are offers ranked on the 2nd or 3rd place that presents the same price (aconsidering that the maximum number of economic operators with which the framework agreement will be concluded is 3 (three)), the division will be done up to the level of the offer ranked on the first place, respectively the second place without changing the initial ranking.

3.Contracts Subsequent will be concluded according to needs and the allocated budget, with the operator ranked on the 1st place. The contracting authority will continue the procedureaward, even if there will be only one economic operator with the admissible offer per lot, and will conclude the framework agreement only with that economic operator. the contracting authority has the right to unilaterally terminate the framework agreement.

5. In case the signatory economic operator of aui contract subsequent to the framework agreement does not honor its contractual obligations, the contracting authority has the right to conclude a subsequent contract at the framework agreement, with the economic operator ranked on the next place, after that economic operator has been consulted.

6. The bidder assumes sole responsibility for the legality and authenticity of all documents presented in theiginal and / or copy in order to participate in the procedure. The analysis of the documents presented by the bidders by the evaluation commission does not undertake any responsibility or obligation on its part to accept them as authentic or legal and does not remove the exclusive responsibility of the bidder in this respect.

7. In case the bidder declared the winner does not honor his orderiles, within the term established by the subsequent contract, the contracting authority has the right to terminate totally or partially the supply contract for the products covered by it and we will draw up, according to art. 166 of HG395 / 2016, the finding document that we will publish in SICAP, by which we will mention that it has not fulfilled its contractual obligations towards our unit, and on viitor, in the event of non-fulfillment of the contractual obligations, the exclusion from a procedure for the award of a public procurement contract. medicines, sanitary materials, protective equipment, services, fuel and lubricants for the parkauto, for which centralized procurement procedures are organized at national level, the contracting authority will unilaterally terminate the framework agreement for the products included in the centralized public procurement list at the MS, after the completion of the centralized procurement procedures.
