Consulting Services for National Resettlement Policy and Act Development

1. The Government of Sierra Leone has established the Millennium Challenge Coordinating Unit (“MCCU”) as an autonomous entity with independent legal authority to oversee, manage, and implement a Threshold Program funded by the Millennium Challenge Corporation (“MCC”). MCC is a U.S. government agency focused on assisting countries dedicated to good governance, economic freedom, and investments in people.

2. The MCC Threshold Program with Sierra Leone will provide up to $44.4 million to support significant policy reforms and improve governance in the water and electricity sectors. By establishing independent regulation, strengthening key institutions, and increasing transparency and accountability, the program seeks to create a foundation for the financially sustainable provision of essential water and electricity services, as well as limit opportunities for corruption in service delivery. The Threshold Program will run for up to four (4) years after the entry into force of the Millennium Challenge Account Threshold Program Grant Agreement (“Threshold Program Agreement”) which occurred in February 2016.

3. The Request for Proposals (RFP) follows the General Procurement Notice that appeared in dgMarket on and UNDB Online on 10 and 9 April 2018 respectively and Concord Times newspaper on 11 April 2018.

4. MCCU now invites proposals from legally constituted consulting firms to provide the consultant services referenced above. More details on these consultant services are provided in the Terms of Reference. This RFP is open to all eligible entities (“Consultants”) who wish to respond. Subject to restrictions noted in the RFP, consultants may associate with other consultants to enhance their capacity to successfully carry out the assignment.

5. The consultant services, and the contract expected to be awarded is for a period of 6 to 14 months (6 months for Phase 1 and 8 months for an optional Phase 2).

6. A Consultant will be selected under the Quality and Cost-Based Selection (QCBS) Method, the evaluation procedure for which is described in sections of the RFP in accordance with “MCC Program Procurement Guidelines” which are provided on the MCC website (www.mcc.gov/ppg). The selection process, as described, will include a review and verification of qualifications and past performance, including a reference check, prior to the contract award.

PART 1 – PROPOSAL AND SELECTION PROCEDURES
Section I Instructions to Consultants
This section provides information to help potential Consultants prepare their Proposals; it also provides information on the submission, opening, and evaluation of Proposals and on the award of the proposed contract.
Section II Proposal Data Sheet
This section includes provisions that are specific to this procurement and that supplement Section I, Instructions to Consultants.
Section III Qualification and Evaluation Criteria
This section specifies the qualifications required of the Consultant and the criteria to be used to evaluate the Proposal.
Section IV A Technical Proposal Forms
This section provides the Technical Proposal Forms which are to be completed by a potential Consultant and submitted in a separate envelope as part of a potential Consultant’s total Proposal.
Section IV B Financial Proposal Forms
This section provides the Financial Proposal Forms which are to be completed by a potential Consultant and submitted in a separate envelope as part of a potential Consultant’s total Proposal.
Section V Terms of Reference
This Section includes the detailed Terms of Reference that describe the nature, tasks, and duties of the consulting services to be procured.
PART 2 – CONDITIONS OF CONTRACT AND CONTRACT FORMS
Section VI Contract Agreement and General Conditions of Contract
This section contains the form of Contract proposed to be entered into between the MCCU and Consultant.
Section VII Special Conditions of Contract and Annexes to Contract
This section contains the form of those clauses of the Contract that supplement the GCC and that are to be completed by MCA Entities for each procurement of Consulting Services. This section also includes an Annex to the Contract (Annex B: Additional Provisions) that contains provisions that are a part of the Government’s and the MCA Entity’s obligations under the Threshold Program Agreement and related documents which, under the terms of the Threshold Program Agreement and related documents, are required to be transferred onto any Consultant, Sub-Consultant or Associate who partakes in any MCC-funded procurement.

7. Please note that a Pre-Proposal Conference will be held on the date as described in the Proposal Data Sheet (“PDS”), Section II of this RFP.

8. Consultants interested in receiving the RFP and submitting a Proposal should register their interest by sending an e-mail (with subject: Request for NRPAD RFP) to the Procurement Consultant on franklin@ebmse.com, giving full contact details of the Consultant. This will also ensure that the Consultants receive updates regarding the RFP.

9. Proposals must be delivered in the manner specified in Section I - ITC 17, no later than 10.00am GMT of 30 August 2018.
