Tender Details

Tenders are invited for International Consultant to develop the Action Plan for the Negotiating Chapter 2 - Freedom of movement for workers.

Background

The aim of freedom of movement for workers policy is to enable EU citizens to move to, reside, study, or work in any of the EU Member States. Freedom of movement for workers, which is embedded into the EU treaties, is an integral part of the single market and a central element of its success. It encourages economic development and enables people to travel and spend across borders. The acquis under this Chapter provides that EU citizens moving to another Member State have certain rights. These rights include: right to work without a working permit (except workers from new Member States undergoing an interim period), national treatment for labourers seeking employment in another Member State, right to equal social security as the nationals, right of family members to accompany the worker and receive family remuneration, full coordination of the social security systems, and mutual recognition of qualifications.

The EURES is a European public employment services network, which aims to promote freedom of movement for workers within the EU, and especially by means of close cooperation between national employment services with the view of exchanging information on employment possibilities. The European Health Insurance Card (EHIC) is a free card that enables EU citizens to use medical services during their temporary stays in any EU Member State, Iceland, Lichtenstein, Norway, and Switzerland and pay the same price (or get them for free in some States) for those services as their nationals.

Montenegro has opened this Negotiating Chapter on December 11, 2017 and having in mind the complexity of work in this phase of development of negotiating platform for Montenegro, it is necessary to have additional expert support in the preparation of the Action Plan for the Negotiation Chapter 2.




Duties and Responsibilities

Objectives of the assignment:

The objective of the assignment is to engage the international consultant to develop the Action Plan for the Negotiating Chapter 2 - Freedom of movement for workers. The Action plan needs to be developed in local language, based on the inputs of the competent institutions, primarily Ministry of Labour and Social Welfare (MLSW). It is necessary that the Action plan contains following elements:

· a normative part;

· a timeframe (adoption of laws, strategies or regulations),

· precisely identified human resources,

· a list of institutions that will be involved in the implementation of the Action Plan and,

· the development of accompanying support plans related to strengthening of administrative capacities in the pre-accession period.

Job content:

Under the guidance of the UNDP Project Manager, international consultant is expected to deliver the following tasks:

· Liaise and ensure constant communication/coordination with MLSW;

· Conduct desk research of the documents provided by the MLSW;

· Conduct a three-day visit to Podgorica in order to work with the representatives of MLSW;

· Prepare the draft of Action plan for negotiating Chapter 2 in local language, based on the inputs of the relevant institutions, primarily MLSW;

· Consider and introduce all comments and suggestions and finalize the document;

· Prepare the Final Report for the assignment, approved by UNDP Project Manager.

The expected results/Deliverables:

Under the guidance of the UNDP Project Manager, international consultant is expected to deliver the following results:

· Undertake a three-day visit to Podgorica in order to work with the representatives of MLSW;

· The Action plan for negotiating Chapter 2 in the local language, based on the inputs of the relevant institutions, primarily MLSW;

· The Final Report for the assignment, approved by UNDP Project Manager.

Timing and reporting:

The international consultant is expected to work 10 days home based and in Montenegro during the assignment. The consultant will be responsible to fulfil the project tasks and to prepare the final report to the UNDP Project Manager, that should contain sufficient detail and information that would allow for the appraisal of the effectiveness to date of the assignment-s activities.

Time duration and travel:

The total duration of the assignment is 10 consultancy days during December 2018. The Consultant will conduct one 3-day visit to Podgorica, Montenegro and the rest of the engagement will be homebased. All travel related costs and the living allowance should be included in the lump sum figure.

Required Skills and Experience

?Education:

· University degree in Social Sciences, preferably in law or economy; An advanced degree would be an asset;

Experience:

· At least 10 years of relevant professional experience;

· Proven expertise and experience in the development of the Action Plan for a Negotiation Chapter;

· Proven knowledge and experience in EU acquis within Chapter 2, in the area of labour market access, EURES - European Public Employment Service Network, Social Security System Coordination and European Health Insurance Card;

· Modern approach to delivery of policy/technical advice, and experience of working with public institutions/bodies;

Languages:

· Good knowledge of Montenegrin language;

· Excellent command of spoken and written English language.

Other:

· Excellent IT skills, including word-processing, database applications, presentation software.

Criteria for selection:

Combined Scoring method will be used. When using this weighted scoring method, the award of the contract should be made to the inidividual consultant whose offer has been evaluated and determined as: (i) responsive, compliant, acceptable, and (ii) having received the highest score out of a pre-determined set of weighted technical and financial criteria specific to the solicitation.

· Technical criteria weight - 70% (Background and education 10%; Relevant previous experience 20%; Substantial knowledge/Required competencies 30%; Required language 10%);

· Financial criteria weight - 30%.
