Tenders are invited for Myanmar: Consultancy Terms of Reference: Training Justice Actors & Development of Community-Based Dispute Resolution Guidelines.

Objectives of the Consultancy

This consultancy comprises three distinct parts:

(1) In coordination with Tdh-s local partner, the Thamardi Foundation, facilitate a 1-day project inception workshop in Yangon with 50 formal and informal justice actors from Yangon in order to share the project goals and approaches and generate their support. Participants will include judges, lawyers, police and community leaders and support group members.

(2) Facilitate, in coordination with the Thamardi Foundation, a first round of training sessions on child rights as outlined in the draft Child Rights Bill and child-friendly legal practices in Yangon for 20 judges (one 1-day session) and 20 police officers (one 1-day session). Thereafter, Tdh and the Thamardi Foundation will go on to train a further 22 judges and 100 police officers.

(3) Support the drafting of community-based dispute resolution (CBDR) guidelines focusing on establishing structures and operating procedures that will help prevent children entering the formal justice system through formal mediation and diversionary measures at the community level. The CBDR guidelines will provide an essential framework of principles and policies to guide the systematic development of CBDR mechanisms, which will be piloted in Hlaing Thar Yar and Dala Townships in Yangon. An integral part of developing the guidelines will include facilitating two 2-day workshops in Nay Pyi Taw with approximately 30 senior government officers from Yangon and Nay Pyi Taw from DSW, the Supreme Court, Police, Law Department, General Administration Dept and the Judicial Sector Coordination Board. It is anticipated that approximately 25 of these officers will go on to constitute the CBDR Technical Working Group that will be responsible for designing and recommending the establishment of formal diversionary and restorative structures and practices within the juvenile justice sector.

Duration of consultancy

The inception workshop and first round of training for 20 judges and 20 police officers should take place consecutively over approximately one week in August 2019. Development of the CBDR guidelines will take place both in-country and remotely over a longer time frame. Between August and December 2019, it is estimated that the Consultant will require a total of 30 days to complete the entire assignment. The CBDR guidelines need to be completed by no later than December 31, 2019 in advance of the official launch in January 2020.

Accountability and support

The Consultant will be accountable to Tdh-s Alternative Care & Juvenile Justice Project Manager and will receive ongoing support from the Country Representative and Country Programme Manager.

Separate from this consultancy, Tdh will hire the services of a professional translator to translate the guidelines from English to Myanmar and will cover the costs of designing and printing the final document.

Tdh will also be responsible for organizing and covering all the costs (hire of venue, transport and food/refreshments for participants, stationery, etc) associated with the various traning sessions and consultation workshops and for covering all transport and accommodation costs for the Consultant when undertaking activities related to this consultancy.

Tdh and the Thamardi Foundation will provide the Consultant with all relevant documents to assist in the process of preparing for the training sessions and developing the guidelines.

Qualifications of the Consultant

· Must have at least 5 years of experience in the juvenile justice field, preferably related to community-based dispute resolution mechanisms, restorative justice and mediation

· Experience facilitating consultation workshops, preferably with Government personnel

· Experience facilitating training sessions

· Experience developing guidelines

· Experience working with I/NGOs

· Excellent spoken and written English.
