Background

The 2030 Agenda for Sustainable Development places gender equality as a cross-cutting approach to achieving the Sustainable Development Goals, with the elimination of violence against women and girls as a crucial component. To that end, the European Union (EU) and the United Nations (UN) have embarked on a new multi-year program, called the 'Spotlight Initiative', which seeks to eliminate violence against women and girls (VCMN). The Spotlight Initiative will model a new way of working in the SDGs. It is also aligned with the EU Gender Action Plan, which has committed an initial € 500 million contribution to the Spotlight initiative worldwide.

The initiative is called Spotlight because it draws attention to this issue, bringing it to the public light and making it the center of all efforts aimed at making gender equality and the empowerment of women, adolescents and girls a reality. The name reminds us that, often, violence takes place in the dark, is denied or hidden and can not survive in broad daylight. It also highlights the importance of investing specifically in women and girls to achieve sustainable development and makes visible this decided and renewed commitment of the European Union and the United Nations.

The Spotlight Initiative focuses on specific forms of VCMN in particular regions, as entry points to address all forms of violence and their structural roots. The specific areas of action in Latin America, and El Salvador is the reduction of feminicide.

In Latin America, the Spotlight Initiative will be developed in five countries: Argentina, El Salvador, Guatemala, Honduras and Mexico. These countries have been selected based on criteria such as: the prevalence level of femicide in the country, the government's commitment to the issue, the enabling environment for civil society, national and partner capacities, among other considerations.

Justification

El Salvador is one of the countries with the highest number of femicide cases in the region; to try to respond to this situation of violence, the government decreed in 2018, a national alarm, so that all State institutions, cooperation and society in general, contribute to prevention and response.

The UNS, for its part, is contributing to these efforts through the Spotlight initiative, which has as its central theme, precisely, the fight against feminicide. UNICEF is the implementing agency in the country and will work, jointly, with other agencies of the United Nations System (UN Women, UNFPA and UNDP), government institutions at the central and local levels, as well as civil society organizations.

The program has been built around six pillars of the Theory of Change of the Spotlight Initiative: legislative and public policy framework, institutional strengthening, prevention and social norms, delivery of essential quality services, data availability and support for movements of women.

In the pillar that corresponds to the legislative framework and public policies, UNICEF has prioritized the revision and harmonization of penal, family and child regulations to adapt it to international standards for the protection of children and adolescents with a gender focus. This, given the need to regulate uniformly and coherently aspects related to child protection against crimes against sexual freedom in relation to minimum age to consent to sexual relations, the review of criminal types and their respective sanctions, as well as the relative to non-marital unions of persons under the age of eighteen, after the reform of the Family Code in 2017 to prohibit child marriage. Likewise, it is necessary that this revision be made taking as a point of reference the Law for the Integral Protection of Children and Adolescents (LEPINA) and the Convention on the Rights of the Child, to ensure that the aforementioned aspects are addressed according to the standards international protection of children. Therefore, it is necessary to have the support of a national consultant with knowledge and experience in criminal matters, family and childhood, who can lead the formulation of the proposal for regulatory harmonization.

How can you make a difference?

Specific objectives

1. Review and analyze the national regulations in criminal areas (crimes against sexual freedom), family and childhood to identify the points of collision between legal provisions affecting children and adolescents.

2. Review and analyze the international regulations for the protection of children and women to make the incorporation of international standards into national legislation in criminal areas (crimes against sexual freedom), family and childhood, guaranteeing the focus on children's rights and gender .

3. Design and implement a participatory methodology to obtain inputs that contribute to the preparation of the proposed harmonization of Salvadoran legislation in the areas of criminal law, family and childhood that meets international standards for the protection of children and adolescents with a gender focus.

Methodology

The consultant will work under the supervision of the protection specialist and will work in coordination with the protection team, as well as with the person coordinating the UNICEF Spotlight initiative.

The main activities that will be carried out:

a. Participate in coordination meetings with the promoter / manager group led by UNICEF.

b. Participate in meetings of the technical advisory group.

c. Conduct consultations with key actors, both government institutions, NGOs, United Nations System Agencies and civil society organizations linked to the participation of adolescents and young people, for the process of regulatory review and harmonization.

d. Prepare planning documents, presentations and progress reports that will be presented to both the promoter / manager group and the technical advisory group, for their feedback and validation.

e. Prepare tools for the collection, systematization and analysis of information during the regulatory review process.

f. Prepare the report and presentation of the regulatory harmonization proposal both to the promoter / manager group and the technical advisory group, for their feedback and validation.

Contract period

The consultancy will last for 6 MONTHS, counted from the signing of the contract.

Working conditions

Supervision, monitoring and quality control of the tasks assigned for this contract will be the responsibility of the UNICEF protection specialist, and will work in coordination with the protection team, as well as with the coordinator of the Spotlight Initiative at UNICEF.

For the present hiring, they have not been considered: physical space in UNICEF, technological and communication equipment or UNICEF institutional email account; the consultant will develop the work using their own means.

The contract is for services, does not cover life or medical insurance, or other benefits. The consultant must process their own medical insurance. UNICEF does not accept any liability for medical insurance or costs arising from accidents and illnesses incurred during the contract, including during official travel. The consultant must present proof of medical insurance before starting the contract. International travel has not been considered for this consultancy. However, if it is necessary during the implementation that the consultant travels on an official mission, UNICEF will cover the travel expenses.

Consider that if selected, the consultant must present solvency of the PNC, criminal records, among other documents.

Confidentiality

All the information shared during the contract, both the products that are made and campaigns that are planned, are property of UNICEF and may not be used in other spaces without prior authorization.

The improper use of these documents or of the information known during the performance of the consultancy will be sanctioned in accordance with the stipulations of the respective laws and will lead to the automatic termination of the contract without liability for UNICEF.

Estimated budget

The total cost of the consultancy would be established taking into account the economic proposals received during the selection contest.

The payments will be made against delivery of invoice and products in digital, in editable version.

Required profile

1. University degree in legal sciences, with practical experience in criminal areas, family and childhood.

2. With proven experience (5 to 10 years) in technical assistance for the preparation of legislative proposals, especially in the area of ??family, criminal and childhood.

3. With knowledge of gender, rights of childhood and adolescence, and of women in related areas.

4. Experience in working with government (at the central and local levels), donors and civil society organizations and women's movements.

5. Desirable previous work experience in the United Nations.

6. Excellent oral and written communication skills.
