Brief Background of the Consultancy

The minimum age of criminal responsibility in Zambia is set at the very low age of 8 years[1]. Detention of children is not used as a last resort, and there is no specific law that provides for and fosters the implementation of diversion. In Zambia, it is an established practice to incarcerate children below 18 years in detention facilities and for a prolonged period. First -time child offenders, accused of misdemeanor are imprisoned or given custodial orders in children’s correctional institutions such as a reformatory school. Although the law provides for some alternatives to detention, such as probation, conditional sentence to community service and suspended sentences, there are no explicit provisions for diversion programmes as diversion is not yet entrenched in the Zambian laws. This situation causes several challenges, not only to the effective implementation of diversion but to child protection in general.

Rationale and key aspects of the overall context of the assignment;

The National Consultant will support the Department of Social Welfare (DSW) in the Ministry of Community Development and Social Services (MCDSS) to pilot the National Framework for Diversion (NFD) in the 3 selected districts of Lusaka, Kapiri Mposhi and Kitwe. In order to guide and inform the pilot process, the national consultant will support the District Social Welfare Officers, and District Technical Working Groups (DTWG) comprising representatives of Police, Social Welfare, Public Prosecutors, Magistrates and NGO service providers. The roll out of the pilot phase will be a participatory process, promoting maximum input from all the relevant stakeholders. At National level, the consultant will support the Senior Social Welfare Officer responsible for Statutory Services and will liaise with the National Technical Working Group (NTWG) with representatives from the Child Justice Forum (CJF) and relevant government and non-government agencies, including Ministry of Justice and its agencies, Ministry of Community Development and Social Services (MCDSS), Zambia Police (ZP), Human Rights Commission (HRC), National Prosecutions Authority (NPA), the Judiciary, Zambia Law Development Commission (ZLDC) and Human Rights Commission. The National Consultant will work from the offices of the MCDSS and regularly visit partners and stakeholders in pilot districts.

Objective/Target

The purpose of this consultancy is to provide technical assistance to the DSW in the set up and operationalization of the pilot of the National Framework for Diversion in three Districts of Lusaka, Kapiri Mposhi and Kitwe for a period of 11.5 months effective July 2018.

Description of the assignment (Scope of work) / SPECIFIC TASKS

The National Framework for Diversion aims to assist all stakeholders, including the Police, Social Welfare, Public Prosecutors, Magistrates, NGO service providers and traditional mediation structures to respond to child offending by way of diversion out of the formal criminal justice system, in accordance with the UN Convention on the Rights of the Child (UNCRC). The pilot of the National Framework for Diversion seeks to initially roll out the framework in 3 districts of Lusaka, Kapiri Mposhi and Kitwe with the aim of drawing lessons with regard to the relevance, feasibility, and scalability of framework to national level. Under the joint supervision of the Ministry of Community Development and Social Services and UNICEF, the National Consultant will provide technical assistance to the National and District level staff of the MCDSS and stakeholders in the set up and operationalization of the pilot. In particular, the consultant will be expected to perform the following tasks:

· Support the mapping of all key stakeholders including diversion service providers in each of the 3 districts and provide technical guidance for addressing gaps and weaknesses noted in the mapping exercise.

· Support the District Social Welfare Officers and the Diversion TWG in Lusaka, Kapiri Mposhi and Kitwe district (comprising of representatives of the Police, Social Welfare, Public Prosecutors, Magistrates and NGO service providers) to coordinate implementation of the pilot.

· Support the MCDSS to develop and implement an accreditation for the diversion services providers that provide mediation, restitution and rehabilitation services.

· Work with the MCDSS to promote growth and development of diversion in the three pilot districts through organization and evaluation of focused training and refresher trainings, follow up visits, coaching and mentoring of district level stakeholders.

· Facilitate monitoring and evaluation exercises in the implementing districts ensuring data flow based on the monitoring framework and plan.

· Liaise with Child Protection Specialist, National TWG and provide them with advice on policy issues regarding diversion.

· Provide input and facilitate the process of development of a Communications strategy and plan and supports its implementation including through development of a leaflet, district level events and one national level event.

· In consultation with the MCDSS and key stakeholders; and based on pilot results, assess and make recommendations and develop a national plan of action for scale-up.
