Description: This announcement serves to conclude drug discount agreements pursuant to Section 130a (8) SGB V above the active substance (s) mentioned under point II.1.1). It is not the award of public procurement within the meaning of Directive 2014/24 / EU or §§ 97 FF GWB. Contracting Partner may become any pharmaceutical entrepreneur in accordance with § 4 (18) AMG. According to the case-law of the ECJ, such approval procedures are not necessarily subject to procurement law, as no competition takes place due to the missing selection decision.
