Organizational context and General Background of Assignment

The office of the United Nations High Commissioner for Refugees (UNHCR) is mandated to lead and co-ordinate international action to protect refugees and resolve refugee problems worldwide. Its primary purpose is to safeguard the rights and well-being of refugees. It strives to ensure that everyone can exercise the right to seek asylum and find safe refuge in another State, with the option to return home voluntarily, integrate locally or to resettle in a third country. It also has a mandate to help internally displaced persons and stateless people. In more than six decades, the agency has helped tens of millions of people restart their lives.

In Kuwait, there is no specific legal framework or institution governing refugee issues. The country is not signatory to the 1951 Convention, neither to the 1967 Protocol. Thus, durable solutions are very limited. Full local integration is not feasible as the country treats the refugees and asylum seekers based on immigration rules, meaning they are considered as foreigners and if not in line with these regulations, can be exposed to heightened protection risks.

Given the context, resettlement is considered to be the only durable solution available and most appropriate protection tool for many cases. The office of UNHCR in Kuwait undertakes Refugee Status Determination interviews, identifies cases with special needs and refers the most vulnerable cases that meet the criteria, for resettlement.

In 2017, following the US Executive Order on the moratorium of Syrian refugee resettlement to US, the Office-s resettlement quota has been significantly reduced. However, the office is still referring emergency and urgent cases for resettlement.

Given the circumstances, UNHCR Kuwait is in the process of implementing CBP approach within the whole refugee community in Kuwait. This program requires close monitoring with the different service providers, volunteers- training, conducting continuous outreach activities and persistent capacity building of the partner-s network. Moreover, the office has a significant backlog of registration cases and more applications being received by the office on daily basis.

Functional expertise and responsibilities

· Coordinate the design, implementation and evaluation of Community Based Protection related to programming.

· Develop strong links with a cross-section of members of PoCs/ refugee/ and host communities, using an AGD approach.

· Expand the Community Based Protection and build its network within the Iraqi and Syrian Community in Kuwait.

· Conduct awareness raising sessions on protection topics in communities, with the support of the different community outreach focal points.

· Daily management of community focal points (volunteers) including weekly meetings.

· On the job training and coaching of community focal points (volunteers) on different topics but prioritizing: minimum protection standards, consent and confidentiality standards and how to work with community based protection strategies.

· Report on special needs cases and advise on type of assistance, following discussions with the community focal points (volunteers).

· Refer protection cases to the relevant partners mainly in the health, food assistance and education sectors; including updating the database on case referrals and feedback.

· Actively work on expanding the Partners- network within the Private Sector enhancing protection services for all PoCs.

· Assist with the overall awareness on protection and capacity buildings activities.

General Protection Activities

· The Associate Protection/ Community Services Officer normally reports to the Protection Officer or the Senior Protection Officer. He/she monitors protection standards, operational procedures and practices in protection delivery in line with international standards and provides functional protection support to information management and programme staff.

· The Associate Protection/ Community Services Officer is expected to coordinate quality, timely and effective protection responses to the needs of populations of concern and identify opportunities to mainstream protection methodologies and integrate protection safeguards in operational responses in all sectors. He/she contributes to designing a comprehensive protection strategy and liaises externally with authorities and partners on protection doctrine and policy as guided by the supervisor.

· The Associate Protection/ Community Services Officer also ensures that persons of concern are involved with the Office in making decisions that affect them, whether in accessing their rights or in identifying appropriate solutions to their problems. To achieve this, the incumbent will need to build and maintain effective interfaces with communities of concern, local authorities and protection and assistance partners;

· Make reasoned legal assessments and recommendations concerning the status of applicants for refugee status in accordance with the relevant international legal instruments governing the protection of refugees in accordance UNHCR guidelines and procedural standards.

· Under the direct supervision of the Protection Officer conduct refugee status determination (RSD) interviews and draft RSD assessments, particularly for residual cases within the RSD backlog.

· Perform other relevant duties as required.

Monitoring and Progress Controls

· The incumbent will work in the premises of the UNHCR Kuwait, make contributions as per the ToR and directly report to the Protection Officer. A regular monitoring of his/ her activities as well as progress controls will thus be guaranteed.

Required Qualifications and Experience

a. Education (Level and area of required and/or preferred education)

• University degree in a related field.

• Excellent knowledge of English and working knowledge of Arabic.

b. Work Experience

• At least 2 years of relevant professional experience with a humanitarian aid Organization.

c. Key Competencies

Required Competencies

• Understanding of protection, human rights, international law and humanitarian principles.

• Knowledge of the GCC political and protection context.

• Familiarity with key international standards for humanitarian work.

• Excellent reporting skills.

• Strong coordination, communication skills.

Desired Competencies

• Proficient in Microsoft Word and Excel

• Team player, flexible, able to handle pressure well and work in cross-cultural setting.
